Abstract:Osrednja tematika tega diplomskega dela je molk organa v upravnem postopku. Pisanje se osredotoča predvsem na to, kaj lahko oseba kot stranka v upravnem postopku stori, če na odgovor s strani organa čaka dlje od predvidenega. Izvorna ideja molka organa temelji predvsem na zahtevi, da mora biti zagotovljeno pravno sredstvo, ki ga lahko stranke (v našem primeru udeleženci upravnopravnih razmerij) uporabijo ter tako varujejo in uresničujejo svoje pravice. Če stranka s strani pristojnega organa v predpisanem roku ne dobi odgovora, se mora v postopku aktivirati sama. To lahko stori po zakonsko urejeni podlagi, ki molčečnost organa sanira s fikcijo negativne odločbe. S pomočjo zbiranja literature, ki je bila doslej napisana na temo molka organa, deskriptivno in nato z združevanjem bistvenega za stranko, ki se v postopku sreča z molkom, v celovito sliko, so predstavljeni koraki, ki jim stranka v postopku pred upravnim organom lahko sledi, kadar pride do neodzivnosti organa, in sicer od molka na prvi stopnji do možnosti upravnega spora, če je to potrebno. Čas je nezanemarljiv dejavnik, še toliko pomembnejši, ko gre za varovanje pravic posameznikov ter javnih koristi, saj so posledice zamud lahko precejšnje. Zato je usmerjanje k odločitvam v razumnem časovnem okviru pomembna težnja, ki zagotavlja učinkovitejše varstvo pravic strank v postopkih ob dejstvu, da je za aktiviranje razpoložljivih mehanizmov potrebna angažiranost stranke same.

Abstract:The main topic of the thesis is the institute of administrative silence. The thesis mainly focuses on what can an individual as a party in the administrative procedure do if the administrative authority does not process his request within the required time limit. The main idea of the institute of administrative silence is that in this case the individual (in this case as a participant in administrative law relationship) needs to have access to a legal remedy in order to effectively protect and enjoy their rights. If the party does not receive an answer from the administrative authority within the required time limit, they need to take an active role in the proceedings. The basis for taking the active role is provided in the law where it is prescribed that the failure of the authority to process a request results in a fiction of a negative decision. By way of gathering relevant literature that has been written on the topic of administrative silence, its review and compilation of all its parts that are relevant for the party facing the silence of authority in the administrative procedure into a comprehensive picture, we present the steps that the party in the administrative procedure can take in case of silence of the authority. These steps range from the institute of administrative silence on the first instance to the option of administrative dispute if the party considers it necessary. One should not underestimate the importance of time limits in providing effective rule of law, which is even more important when it comes to protecting individuals' rights and public good, as delayed decisionmaking in these areas can have serious consequences. Therefore encouraging sticking to a reasonable timeframe in decisionmaking is an important issue which helps guaranteeing effective protection of parties' rights in the proceedings, while at the same time one should keep in mind that in order to effectively use the mechanisms that protect their rights, the parties must become active themselves.
