Title:Predporočna pogodba v Sloveniji in Ameriki ter krivda za ločitev : diplomsko delo

Abstract:Od 15. aprila 2019 je tudi v Sloveniji mogoče skleniti predporočno pogodbo, kar pomeni večjo avtonomijo za državljane in pomemben korak za naše družinsko pravo. Namen diplomske naloge je bil predvsem ugotoviti, kako je predporočna pogodba urejena v Sloveniji in v Ameriki ter kakšne so razlike med obema sistemoma, s poudarkom na krivdi za razvezo zakonske zveze. V Sloveniji sicer krivde za razvezo ne upoštevamo, z anketo pa smo ugotavljali, ali so Slovenci sploh naklonjeni sklepanju predporočnih pogodb in ali si želijo, da bi se tudi pri nas lahko upoštevala krivda za razvezo zakonske zveze. Pri tem smo upoštevali tudi dejavnike, ki vplivajo na odnos do predporočne pogodbe, kot sta starost in spol anketirancev. Čeprav gre za novost, s katero še niso dovolj seznanjeni, so Slovenci predporočni pogodbi v glavnem naklonjeni. Starost ni dejavnik, ki bi vplival na odnos do predporočne pogodbe, zanimivo pa je, da so moški do pogodbe bolj zadržani. Tudi upoštevanje krivde za razvezo zakonske zveze se Slovencem zdi dobra ideja. Kar 67 % jih je mnenja, da je ameriški sistem, ki krivdo upošteva, boljši od slovenskega in bi si želeli, da se krivda upošteva tudi pri nas. V zvezi s predporočno pogodbo v Sloveniji še ni dosti sodne prakse, vendar pa se bo sčasoma tudi ta oblikovala. Z razvojem prava v smeri večje avtonomije je torej čisto mogoče, da bo v prihodnosti tudi slovenski zakonodajalec razmislil o možnosti upoštevanja krivde za razvezo zakonske zveze.

Abstract:Beginning on April 15, 2019, and onward, a prenuptial agreement was established in Slovenia. This allows greater autonomy for citizens and is an important step forward in Slovenian family law. The purpose of this thesis statement is to determine, how the prenuptial agreement is regulated in Slovenia and juxtapose it with the United States of America while noting the main differences between the two systems; The main focus on the culpability of separation. The responsibility for separation in Slovenia is not taken into account. Recent polls were conducted to show if Slovenes were inclined to conclude prenuptial contracts and whether they wish the fault of separation could be held accountable. Despite being a novelty and relatively unfamiliar, Slovenes are generally in favor of prenuptial agreements. While age is not a factor that influences attitudes towards a prenuptial agreement, men are more restrained towards the agreement. The guilt of separation also seems a good idea to Slovenes. Nearly 67% think that the American system, which considers the blame, is better than the Slovenian method and would prefer blame to be taken into account. Currently there is not yet a lot of jurisprudence regarding the prenuptial agreement in Slovenia, however, it will eventually take shape. With the development of law in the direction of greater autonomy, the future of Slovenian legislature may include the guilt of separation; Undoubtedly reflecting the juxtaposition with the American system.
