Title:Členi ILC o odgovornosti držav za mednarodna protipravna ravnanja in njihova pravna narava : diplomsko delo

Abstract:Temeljni nalogi Komisije za mednarodno pravo sta kodifikacija in progresivni razvoj mednarodnega prava. Pri svojem delu Komisija ugotavlja, kaj je pravzaprav pravo, oziroma katera pravila lahko smatramo kot norme običajnega mednarodnega prava in nato skozi proces kodifikacije neko področje celovito in sistematično uredi. Področje odgovornosti držav je ena izmed najpomembnejših in najzahtevnejših tem, ki jih je Komisija preučevala in rezultat njenega dolgoletnega dela predstavljajo Členi o odgovornosti držav za mednarodno protipravna ravnanja. Glede njihove pravne narave se porajajo številna vprašanja, predvsem ali odražajo ustaljeno prakso med državami in je njihova narava zavezujoča. Mnenja so danes še vedno deljena, čeprav so Členi o odgovornosti držav v praksi vse pogosteje omenjeni in uporabljeni. Nekatere države zagovarjajo stališče, da predstavljajo avtoritativna pravila s področja odgovornosti držav in bi bilo njihovo besedilo smotrno pretvoriti v konvencijo in s tem utrditi njihovo zavezujočo naravo, spet druge pa so mnenja, da se praksa med državami glede njih še ni dovolj razvila. Ne glede na njihovo usodo, pa je gotovo, da so Členi o odgovornosti držav za mednarodno protipravna ravnanja pomembno vplivali na mednarodno sodno prakso in literaturo. Meddržavno sodišče, ki ima pristojnosti izdajati inter partes pravno zavezujoče sodne odločbe, je v svojih sodbah nemalokrat navedlo pravila in načela, povzeta v omenjenih členih, kar jim daje le še večjo veljavo in avtoriteto.

Abstract:International law commission's declared object is codification and promoting the progressive developement of international law. In the process of codification ILC determinates what law actually is and which norms of international law can be specified as custom. When primary rule is determened, the commission systematically and comprehensively regulates the field of discussion. One of the most complicated topics Commission has dealt with was state responsibility and finally, Draft articles on state responsibility emerged. There are several questions concerning what the legal nature of this articles is and whether they have established state practice in respect, how often they are reffered to in decisions of various international courts, tribunals and other bodies. There are some opposing opinions whether they demonstrate general acceptance in international community. Some states favoured negotiating a convention and the view was expressed that they are already a well conceived secondary rules. On the other hand, number of states expressed concern that resulting a convention would be premature. Regardless their uncertain future they undoubtedly influence judical decisions and literature. The International Court of Justice, which has jurisdiction to issue inter partes binding judgments, has repeatedly stated in its judgments principles summarized in the aforementioned articles, giving them only greater validity and authority.
