Title:Ukrepi za varstvo koristi otroka po Družinskem zakoniku : diplomsko delo

Abstract:Obravnavana tema diplomskega dela so ukrepi za varstvo koristi otroka po Družinskem zakoniku. Vselej, kadar starši, kot primarni nosilci starševske skrbi, neustrezno izvajajo starševsko skrb, nastopi dolžnost države, da otroka in njegove pravice ter koristi zavaruje. Družinski zakonik za osrednji instituciji za varstvo otrokove koristi postavlja sodišče in center za socialno delo, ki sta pooblaščena za izvedbo vseh potrebnih dejanj in ukrepov, ki jih terja varstvo otrokovih pravic ter koristi. Pogoj za izrek ukrepa za varstvo koristi otroka je otrokova ogroženost. Po novi ureditvi sme ukrepe po uradni dolžnosti ali na predlog izreči le sodišče, pri čemer mora upoštevati načelo najmilejšega ukrepa. Ker so otroci danes subjekt pravic in imajo pravico biti slišani v vseh zadevah v zvezi z njimi, imajo pri odločanju o ukrepu pravico izraziti svoje mnenje. Družinski zakonik ukrepe za varstvo koristi otroka deli na začasne odredbe, nujni odvzem otroka in ukrepe trajnejšega značaja. Pristojnost za ukrepanje v nujnih primerih ima po Družinskem zakoniku center za socialno delo, ki sme v ta namen izvesti dejanje nujnega odvzema otroka. Center za socialno delo je hkrati zakoniti predlagatelj postopka za odločanje o ukrepih za varstvo koristi otroka in izvajalec nadzora nad izrečenimi ukrepi, okrepljena pa je tudi njegova svetovalna ter podporna vloga.

Abstract:My diploma thesis addresses measures for the care and benefit of a child, in line with the Family Act. Whenever parents, who are primarily held liable for a parental care, act in non-parental care manner, the state's duty is to take over in order to protect the child's rights and benefits. According to the Family Act, the central institutions for the protection of the child's benefits are the court and a social care centre, which are both authorized to do everything necessary and to act accordingly in order to protect the child's rights and benefits. A condition of imposition of a measure for the protection of the child's benefit is the child's endangerment. According to the new regulation, the measure ex officio, or on proposal, may be imposed by the court only, provided to take into account the principle of the least lenient measure. As today children are subject to rights and have the right to be heard in all matters concerning them, they have the right to express themselves in rendering a decision on the measure. The Family Act divides measures for the protection of the child's benefits into provisional measures, urgent child abduction and measures of more permanent nature. According to the Family Act, authorities to act in urgent cases are given to the social care centres, which may act in the urgent child abduction. Social care centres are, at the same time, legal proposers of the procedure in rendering decisions on measures for the protection of the child's benefits and are supervisors over the imposed measures, whereas their consulting and supporting role has become even more enhanced.
