Title:Analiza sodbe Sodišča Evropske unije v zadevi Avstrija proti Nemčiji (C-591/17) : diplomsko delo

Abstract:Osrednji del diplomskega dela predstavlja analiza nedavno sprejete sodbe SEU v zadevi Avstrija proti Nemčiji (C-591/17) glede načela prepovedi diskriminacije na podlagi državljanstva, ki v strokovni literaturi še ni (obsežno) preučena. S pomočjo deskriptivne metode smo predstavili tožbo zaradi neizpolnitve obveznosti po pravu EU. Z uporabo zgodovinske metode smo si pomagali pri prikazu dosedanje sodne prakse SEU v zadevah, ki so potekale na podlagi 259. člena PDEU. Za preučitev sodbe je bila ključna metoda analize. V sklepnem delu diplomskega dela smo uporabili metodo sinteze. Pojasnili smo razloge, zaradi katerih je postopek, v katerem tožbo zaradi neizpolnitve obveznosti vloži država članica EU proti drugi državi članici EU, izjemno redek. Ključne pa so ugotovitve, ki se nanašajo na preučitev sodbe SEU v zadevi Avstrija proti Nemčiji. Predstavili smo ozadje primera in kot ključni argument SEU izpostavili ugotovitve, ki izhajajo iz presoje prvega očitka, v katerem je bilo ugotovljeno, da je posledica sporne nemške zakonodaje manj ugodna obravnava lastnikov in voznikov vozil, ki so vozila registrirali v drugih državah članicah, v primerjavi z lastniki vozil, ki so vozila registrirali v Nemčiji. Poleg tega smo v diplomskem delu navedli pet posledic, ki jih (lahko) ima konkretna sodba za države članice in EU. Posledice smo preučili v sklopu širše sodne prakse SEU v zvezi s postopkom na podlagi 259. člena PDEU in z vsebinskega vidika.

Abstract:The main part of the graduation thesis consists of the analysis of the recently issued decision of CJEU in the matter of Austria v Germany (C-591/17), in which CJEU considered the principle of prohibition of discrimination on the grounds of nationality, and which therefore has not been studied (extensively) in literature. With the help of a descriptive method we present the action for failure to fulfil obligations under the EU law. With a historic method we present the CJEU case law. The key method used for the study of the decision was analysis. In the conclusion we use the method of synthesis. We clarify the reasons, for which the process, where the action for failure to fulfil obligations brought on by a member state, is extremely rare. We present the background of the case, and highlight the key arguments of the CJEU, which come from the judgement of the first complaint. The thesis also includes the five consequences, which said judgement has for the EU member states. The consequences are discussed from the viewpoint of a wider CJEU case law in connection with the procedure under Article 259 of TFEU, and from the view of the content.
