Abstract:Študentsko delo je začasno in občasno delo dijakov, študentov ali drugih opravičenih oseb, ki morajo imeti za opravljanje študentskega dela veljaven status dijaka ali študenta v Republiki Sloveniji ali status udeleženca v izobraževanju odraslih. Velikokrat se srečujemo z dejstvom, da dijaki in študenti delajo z nalogami in dolžnostmi delovnega razmerja, ne pa tudi z njegovimi pravicami in ugodnostmi. Ključna razlika med študentskim delom in pogodbo o zaposlitvi je v tem, da se študentsko delo ne opravlja nepretrgoma, temveč občasno in začasno. V praksi se kaže, da je vse več primerov, ko študenti opravljajo enako delo in na enak način kot delavci, ki imajo sklenjene pogodbe o zaposlitvi. Namen diplomskega dela je predstaviti ureditev študentskega dela v Sloveniji. V prvem delu je opisan razvoj študentskega dela in njegova zakonska podlaga. Temelji na pravicah in dolžnostih dijakov, študentov in udeležencev izobraževanja odraslih v času formalnega izobraževanja. V jedru diplomskega dela so predstavljene prednosti in pomanjkljivosti študentskega dela z vidika dijakov in študentov ter delodajalcev. Cilj diplomskega dela predstavlja zakonsko ureditev na področju študentskega dela v Sloveniji, opredeljuje trenutno stanje, ki je zelo pogosto med dijaki, študenti in delodajalci, ter podaja predloge izboljšav, predvsem s poudarkom na preprečevanju zlorab in izkoriščanju dijakov in študentov. Izvedeno je predvsem s pomočjo opisne in deloma tudi primerjalne metode ter s pregledom literature. V diplomskem delu je potrjena zastavljena hipoteza: "Ali bi z ukrepi zaposlovanja za absolvente oziroma mlade diplomante preprečili zlorabe in izkoriščanje dijakov in študentov?"

Abstract:Student work is temporary and occasional work of high school students, students or other justified persons, who must have, to perform work, valid student status in Republic of Slovenia or the status of a participant in adult education. Many times, we are confronted with the fact that high school students and students are working with tasks and duties of employment relationship, but not with their rights and benefits. The key difference between student work and an employment contract is that student work is not performed on a continuous basis but occasionally and temporarily. We find that in practice there is a growing number of cases where students do the same job and in the same way as workers who have employment contracts. The purpose of the thesis is to present the organization of student work in Slovenia. In the first part of the thesis, is described the development of student work and the legal basis for it. Focus is on the rights and duties of students, college students and participants in adult education during formal education. At the core of the thesis are presented the advantages and disadvantages of student work, from the perspective of students and employers. The aim of the thesis is to present the legal regulation in the range of student work in Slovenia and to identify the current situation, which is very common among students, college students and employers and to make suggestion for improvement, especially with emphasis on the prevention of abuse and exploitation of students and college students. Primarily is maded through a descriptive method, partly through comparative and literature review. The following hypothesis is put forward in thesis: Would employment measures for bachelor and high school graduates prevent the abuse and exploitation of students and college students?
