Abstract:
V magistrski nalogi so predstavljene temeljne človekove pravice in svoboščine ter njihovo uresničevanje na afriškem kontinentu. Ključna varovalka temeljnih človekovih pravic na afriškem področju je nedvomno Afriška listina o človekovih pravicah in pravicah ljudstev, ki s svojimi določbami varuje človekove pravice vsakega posameznika. Afriška listina o človekovih pravicah in pravicah ljudstev je mednarodni dokument, namenjen spodbujanju in varovanju človekovih pravic ter temeljnih svoboščin na afriški celini. Z vzpostavitvijo regionalnega sistema človekovih pravic za Afriko je sledila evropskemu in medameriškemu sistemu. V okviru Listine sta bila sprejeta tudi Protokol k Afriški listini o človekovih pravicah in pravicah ljudstev za pravice žensk v Afriki in Protokol k Afriški listini o človekovih pravicah in pravicah ljudstev o ustanovitvi Afriškega sodišča za človekove pravice in pravice ljudstev. Z ustanovitvijo Afriškega sodišča za človekove pravice in pravice ljudstev se je pričela razvijati sodna praksa, ki pripomore k reševanju ključnih problemov na nacionalnem nivoju afriških držav. Dolgoletne kršitve temeljnih pravic so pripeljale do množičnega nezadovoljstva, zato nastaja čedalje večja potreba po vzpostavitvi močnejšega sistema človekovih pravic za odpravo nepravilnosti in nezakonitosti v posameznih državah. V magistrskem delu želim raziskati, ali se določbe Afriške listine upoštevajo v praksi in v kolikšni meri sodna praksa Afriškega sodišča pripomore k zmanjšanju kršitev temeljnih človekovih pravic.

Abstract:
The Master's thesis presents basic human rights and freedoms and their realization on the African continent. The key safeguard of fundamental human rights in the African field is undoubtedly the African Charter on Human and Peoples' Rights, which, by its provisions, protects the human rights of every individual. The African Charter on Human and Peoples' Rights is an international document designed to promote and protect human rights and fundamental freedoms on the African continent. The establishment of a regional human rights system for Africa followed the European and inter-American system. The Charter also adopted the Protocol to the African Charter on Human and Peoples' Rights for the Rights of Women in Africa and the Protocol to the African Charter on Human and Peoples' Rights on the establishment of the African Court of Human Rights and Peoples' Rights. With the establishment of the African Court of Human Rights and Peoples' Rights, case law has been developed to help solve key problems at the national level of African countries. Longstanding violations of fundamental rights have led to massive dissatisfaction, which is why an increasing need arises to establish a stronger human rights system to remedy irregularities and illegalities in individual countries. In the master's thesis, I would like to explore whether the provisions of the African Charter are taken into account in practice and to what extent the case-law of the African Court contributes to reducing violations of fundamental human rights.
