Title:Prečkanje morske meje EU - schengen, slepi potniki in migranti : magistrsko delo

Abstract:Schengenski režim je pravni red, vpeljan z uveljavitvijo dveh mednarodnih sporazumov, sklenjenih v luksemburški vasici Schengen. Namena sporazumov sta odprava notranjih mejnih kontrol za vse osebe, ki se nahajajo znotraj meja držav EU, in krepitev skupnih zunanjih meja z nečlanicami oz. tako imenovanimi tretjimi državami. Svobodno gibanje na ozemlju držav članic zahteva okrepljeno sodelovanje organov, ki izvajajo varnostni, carinski in inšpekcijski nadzor na kopnem in na morju. Kontrola morske površine in mejni prehodi na morju zahtevajo izjemno pripravljenost organov pregona in mednarodno sodelovanje. Največja grožnja čolnov, ki prevažajo migrante iz Afrike, je poskušanje doseči evropske meje, enako kot velja za slepe potnike, ki počnejo isto, vendar na drugačne načine. Ne toliko zaradi njihove fizične prisotnosti na krovu plovila in posadke, temveč zaradi posledic korakov, ki jih naredijo na zemlji EU. Toda sodelovanje, razumevanje in izmenjava informacij med različnimi stranmi je še en pomemben korak k nadzoru problematike slepih potnikov in migrantov. Kljub najboljšim usklajenim prizadevanjem na ladji, pristaniških terminalih, podjetij, drugih organizacij in držav bo določenim posameznikom občasno še vedno uspelo doseči cilj. Vendar pa bi bilo mogoče zmanjšati pogostost takšnih oseb, in sicer z onemogočanjem dostopa na ladje, ter narediti svet bolj hvaležen za vse.

Abstract:Schengen regime is a legal regulation introduced through the implementation of two international agreements concluded in Schengen, Luxembourg. Agreements' intent is the abolition of internal border controls for all persons situated within the borders of EU states as well as the reinforcement of joint external borders with non-members or so called third states. Freedom of movement on the "territory" of member states requires in-depth cooperation of law enforcement executive authorities in charge of security, customs and inspectory supervision on land and at sea. Sea-surface control and border crossings at sea demand both exceptional alertness of law enforcement and international cooperation. The greatest threat from boats transporting migrants from Africa trying to reach European borders and stowaways doing the same in different ways, not so much their physical presence on board of vessels and for others stress placed on the crew, but the consequences of their steps on ground of EU. However, cooperation, understanding and sharing of information between various parties is another important step to control the problem of stowaways and migrants. Despite the best coordinated efforts of the ship, terminal, companies, other organisations, states, determined individuals will occasionally succeed in stowing away. However, it should be possible to reduce the frequency of such persons gaining access on board and made a World more grateful for everybody.
