Title:Pravica do dostojne smrti : magistrsko delo

Abstract:Magistrsko delo obravnava opredelitev pravice do dostojne smrti, načine, na katere se ta pravica lahko zagotavlja ter trenutno mnenje Slovencev in Slovenk o uporabi teh načinov v konkretnih primerih v praksi. Namen magistrskega dela je predstaviti vrste evtanazije in njim podobna dejanja, ugotoviti, katere vrste evtanazije in njim podobna dejanja se lahko uporabijo kot način za zagotavljanje pravice do dostojne smrti, in zbrati, analizirati ter predstaviti mnenje Slovencev in Slovenk o pravici do dostojne smrti in uporabi izbranih načinov za zagotavljanje pravice do dostojne smrti v Sloveniji. V magistrskem delu so opredeljeni ključni pojmi, predstavljene in med sabo primerjane so vrste evtanazij in njim podobna dejanja. Prvi del raziskovanja zaključuje analiza ankete, kjer so bili anketiranci vprašani, katere vrste evtanazije in njim podobne prakse podpirajo oz. ne podpirajo v Sloveniji. Drugi del magistrskega dela je osnovan na predstavitvi in opredelitvi primerov, ki jih je Evropsko sodišče za človekove pravice obravnavalo v povezavi z evtanazijo in njej podobnimi dejanji. Predstavitvi primerov in izpostavitvi pomembnejših točk sodb, ki se navezujejo na pravico do življenja, prepoved mučenja, nečloveškega in ponižujočega ravnanja ter človekovo dostojanstvo, sledi analiza anket, kjer so vprašanja zasnovana na konkretnih primerih. Osrednji del empiričnega raziskovanja zajema anketna raziskava mnenja o primerih, v katerih Slovenci in Slovenke podpirajo oz. ne podpirajo uporabe evtanazije in njej podobna dejanja v praksi. V zaključnem delu so povzete ugotovitve o definiciji pravice do dostojne smrti, o vrstah evtanazije in njim podobnih praksah ter o podpori legalizaciji načinov evtanazije v konkretnih primerih v Sloveniji.

Abstract:Master's thesis deals with defining the right to a dignified death, presenting different methods in which this right can be ensured, and the current opinion of Slovenians on the use of these methods in practice. In the first chapters of the master's thesis the key concepts are presented, followed by a comparison between different types of euthanasia and practices similar to euthanasia. The first part of the thesis is concluded by the analysis of the survey, in which respondents were asked what types of euthanasia and practices similar to euthanasia they support. The second part of the master's thesis is based on the presentation and analysis of cases that the European Court of Human Rights (ECHR) has dealt with in relation to euthanasia and practices similar to euthanasia. Presentation of cases is followed by their analysis with special emphasis on the parts of judgments relating to the right to life, prohibition of torture, inhuman and degrading treatment and human dignity. The main part of the empirical research includes an opinion survey on support of euthanasia in Slovenia. All cases included in the survey are based on the real cases presented before the ECHR. In conclusion a definition of the right to a dignified death is made, types of euthanasia and practices similar to euthanasia, which can be used as a method to ensure the right to a dignified death are presented, and the opinion of Slovenians on legalizing different types of euthanasia in specific cases in Slovenia is stated.
