Title:Evropska državljanska pobuda : od uveljavitve do danes

Abstract:Evropska državljanska pobuda je instrument neposredne demokracije, ki je bil vpeljan z Lizbonsko pogodbo z namenom zmanjševanja demokratičnega primanjkljaja v Evropski uniji. Evropska državljanska pobuda državljanom Unije omogoča, da Evropsko komisijo spodbudijo k spremembi zakonodaje Evropske unije. Magistrsko delo je razdeljeno na teoretični in empirični del. V teoretičnem delu smo poleg opredelitve in razumevanja demokratičnega primanjkljaja v Evropski uniji proučili temeljne elemente njene demokratične ureditve, ki poskušajo ta primanjkljaj odpraviti ali vsaj zmanjšati: državljanstvo Unije, volitve v Evropski parlament, vlogo nacionalnih parlamentov v Evropski uniji in evropsko državljansko pobudo. Podrobneje je predstavljena prav slednja, pri čemer sta najprej prikazana nastanek in razvoj evropske državljanske pobude, nato pa normativna ureditev njene uporabe, upoštevajoč novosti, ki jih je prinesla nedavno sprejeta Uredba (EU) 2019/788. V empiričnem delu je bila izvedena analiza vloženih evropskih državljanskih pobud (tako uspešnih kot neuspešnih) od uveljavitve do 30. 6. 2019. Prav tako smo prikazali, kakšno pravno varstvo imajo na voljo organizatorji oziroma pobudniki v primeru neaktivnosti Evropske komisije po uspešno izvedeni pobudi. Preučena literatura in viri, izvedena analiza vloženih evropskih državljanskih pobud in sodna praksa Sodišča Evropske unije so nas pripeljali do ugotovitve, da evropska državljanska pobuda v praksi ni zaživela v takšni meri, kot je bilo predvideno, državljani Unije pa se - glede na število vloženih pobud oziroma število dejansko uspešnih pobud - tega instrumenta neposredne demokracije premalo poslužujejo.

Abstract:The European Citizens' Initiative is an instrument of direct democracy, introduced by the Treaty of Lisbon with the purpose of reducing the democratic deficit in the EU. It enables the citizens of the Union to encourage the Commission to amend the EU legislation. The master's thesis is divided into the theoretical and the empirical part. In the theoretical part, in addition to defining and understanding the democratic deficit, the basic elements of democratic order in the EU that seek to reduce this deficit, have been examined: the citizenship of the Union, the elections to the European Parliament, the role of national parliaments in the EU and the European Citizens' Initiative. The latter is presented in more detail: firstly, the development of this instrument in the EU is presented, followed by the normative regulation for its use, taking into account the novelty, brought by the recently adopted Regulation (EU) 2019/788. In the empirical part, an analysis of the submitted European Citizens% Initiatives was carried out, from the entry into force until 30th June 2019. Legal protection in case of inactivity of the Commission following a successfully implemented Initiative was also analysed. The examined literature, the analysis of the submitted Initiatives and the case law of the ECJ have led us to conclusion that the Initiative did not materialize in practice to the extent that it had been envisaged, and that, given the number of initiatives submitted or the number of actually successful initiatives, this instrument is underused by the EU citizens.
