Title:Varstvo pravic po listini temeljnih pravic Evropske unije : diplomsko delo

Abstract:Listina temeljnih pravic Evropske unije je prvi enotni dokument vseh temeljnih pravic v Evropski uniji. Do njenega sprejetja oziroma do njene pravnomočne veljave takega dokumenta še ni bilo. Listina temeljnih pravic je del primarne zakonodaje, to pomeni, da ima najvišji rang v hierarhiji prava in posledično je obvezujoča v vseh državah članicah. Diplomsko delo obravnava varstvo pravic po Listini temeljnih pravic Evropske unije. Opisuje razvoj človekovih pravic in njihov nastanek. Obravnava Listino temeljnih pravic Evropske unije, njen nastanek in razglasitev ter tudi obseg uporabe. Diplomsko delo se osredotoča na vsebino Listine temeljnih pravic Evropske unije in predstavitev njenih členov s pomočjo opisne metode. V nadaljevanju je predstavljena Agencija Evropske unije za temeljne pravice, ki je bila ustanovljena za nudenje strokovnega znanja s področja temeljnih pravic, za spodbujanje in varovanje pravic državljanov Evropske unije. S pomočjo primerjalne metode smo na koncu dela primerjali napredek Listine temeljnih pravic Evropske unije od njene pravnomočne veljave leta 2009 do zadnjega polnega leta delovanja 2018. Na koncu sledi opis, kako pomembno vlogo ima Sodišče Evropske unije na Listino temeljnih pravic. Cilj raziskave je bil odgovoriti na vprašanje, ali je Listina temeljnih pravic Evropske unije izboljšala varstvo človekovih pravic v Evropski uniji in ali je Listina temeljnih pravic v letih delovanja postala prepoznavna med prebivalci Evropske unije.

Abstract:The Charter of Fundamental Rights of the European Union is the first document of fundamental rights in the European Union. Until it has entered into force such document didn't exist. The Charter of Fundamental Rights is a part of primary legislation and it is the starting point for European Union law. It is obligatory for all member states of the European Union. This thesis deals with the protection of fundamental rights in the Charter of Fundamental Rights of the European Union. It describes the development of human rights and their evolution. It deals with the Charter of Fundamental Rights of the European Union, its formation and proclamation as well as the scope of use. The thesis is focused on the content of the Charter of Fundamental Rights of the European Union and it presents their articles using the descriptive method. Furthermore, European Union Agency for Fundamental Rights is presented. It was established to provide expertise in the field of fundamental rights, also to encourage and protect rights of the European citizens. At the end of the thesis I compared the progress of the Charter of Fundamental Rights of the European Union, from the first day of its entrance into force in 2009 until last year 2018, with the comparative method. At last I described how important the Court of Justice of the European Union is for the Charter of Fundamental Rights. The aim of this thesis was to answer the question whether the Charter of Fundamental Rights of the European Union indeed improved the protection of human rights in European Union and whether the Charter of Fundamental Rights has become known among the European citizens.
