Title:Pravica naroda do samoodločbe : magistrsko delo

Abstract:Pravica naroda do samoodločbe je mednarodno priznano pravno načelo že vse od vključitve v Ustanovno listino OZN leta 1945. Pravica naroda do samoodločbe pomeni, da si narod sam določa zunanjo in notranjo politično ureditev in delovanje. Notranja samoodločba pomeni uveljavljanje volje pri oblikovanju gospodarskega, kulturnega in družbenega razvoja znotraj že obstoječe države. Medtem ko zunanja samoodločba predstavlja situacijo, ko država svojemu narodu notranjo pravico odreče in lahko le ta uveljavlja t. i. zunanjo samoodločbo, vključujoč pravico do odcepitve. To opredelitev s pomočjo deskriptivne metode obravnava magistrsko delo v prvem delu. V nadaljevanju se posvečamo posameznim ureditvam, na eni strani velikega jugoslovanskega modela, kjer predstavimo organizacijski ustroj federacije, z vlogo Republike Slovenije, in s pomočjo zgodovinske metode predstavimo razloge za razpad Socialistične federativne republike Jugoslavije in uveljavljanje pravice naroda do samoodločbe s strani Republike Slovenije. Nato enako predstavimo Kraljevino Španijo ter na podlagi zgodovinske metode preidemo na vlogo Katalonije kot avtonomne enote znotraj Španije, nato pa z metodo kompilacije povzamemo ugotovitve različnih avtorjev glede katalonskega uveljavljanja pravice naroda do samoodločbe. Magistrsko delo zaključimo s primerjavo uresničitve pravice naroda do samoodločbe s strani Republike Slovenije in Katalonije ter skupne značilnosti in razlike poiščemo s pomočjo induktivne pravne metode. Ugotovili smo, da se kljub podobni konotaciji slovenska in katalonska uresničitev pravice naroda do samoodločbe bistveno razlikujeta, in sicer je ustava Socialistične federativne republike Jugoslavije priznavala pravico naroda do samoodločbe, vključno s pravico do odcepitve, vsem republikam, medtem ko ustava Kraljevine Španije take dikcije ne vsebuje in zagovarja zgolj en narod, in to španski.

Title:primerjava uveljavljanja pravice med Slovenijo in Katalonijo
Abstract:The right of the nation of self-determination is an internationally recognized legal principle since its inclusion in the UN Charter in 1945. In principle, it represents the right of the nation to provide itself with the international (external) and local or national (internal) political arrangements and operations which is, through a descriptive method, the focus of the master's work in the first part. The second part is devoted to individual arrangements, for example the arrangement of Yugoslavia, where we present the federation's organizational structure. Through the historical method, I'm presenting the reasons for the dissolution of Yugoslavia and the exercise of the right of the nation to self-determination on the case of Slovenia. Later I'm describing the case of the Kingdom of Spain and the role of Catalonia within the state of Spain, an autonomous unit within the state of Spain and the findings of the various authors regarding the Catalan exercise of the right of the nation to self-determination. The last part of the dissertation is devoted to the comparison of realisation of the right of the nation to self-determination on the case of Slovenia and Catalonia, focusing on the common characteristics and differences through an inductive legal method. Despite the similar connotation of the Slovenian and Catalan realisation of the right of the nation to self-determination there are significant difference the biggest being that in contrary to Yugoslav Constitution, Spanish does not recognise the right of the nation to self-determination and advocates only one, Spanish nation.
