Title:Pravna ureditev oskrbe z energijo v Sloveniji glede na predpise Evropske unije : magistrsko delo

Abstract:Evropski energetski sistemi doživljajo obsežne spremembe, ki se bodo še intenzivneje dogajale v prihodnosti. Vzrok za to je okoljska politika, ki zahteva dekarbonizacijo energetskega sektorja. Evropska komisija želi, da Evropa prevzame vodilno vlogo na področju čiste energije. Cilj Evropske unije je energetsko učinkovitost postaviti na prvo mesto, prevzeti glavno vlogo v energiji iz obnovljivih virov, ki vplivajo na spremembe na svetovnih trgih in zagotoviti pošteno obravnavo odjemalcev. Odjemalci so ključni akterji na energetskih trgih prihodnosti. Vse te spremembe zahtevajo večjo prilagodljivost trgov in spremembo obstoječe nacionalne zakonodaje. Osrednji cilj energetske politike je zanesljiva, trajnostna in konkurenčna oskrba z energijo, ki je osnovnega pomena za gospodarstvo vsake države članice Evropske unije in njene državljane. Energetska politika Evropske unije je začrtala skupne smeri, ki se kažejo v poenoteni zakonodaji in skupnih energetsko podnebnih ciljih. Državni zbor Republike Slovenije je na podlagi Direktive 96/92/ES sprejel Energetski zakon, s katerim je Slovenija začela prilagajati slovensko elektrogospodarstvo evropskim smernicam. V magistrskem delu analiziramo zakonodajni razvoj evropske energetske zakonodaje in predstavimo spremembe ter novosti, ki jih določa nov zimski paket "Čista energija za vse Evropejce". Nadalje ugotavljamo, kako bo paket vplival na slovensko energetsko regulativo. V tem kontekstu se ukvarjamo tudi z energetsko politiko Evropske unije in Slovenije ter s pravno ureditvijo slovenskega energetskega sistema, kjer se v večji meri posvetimo predvsem električni energiji. V zadnjem delu nas bo zanimala ureditev varstva odjemalcev in delo regulativnih organov na energetskem trgu.

Abstract:European energy systems are facing radical changes which are expected to even intensify in the future. This is due to environmental policy which requires the decarbonisation of the energy sector. The European Commission wants Europe to take the lead in the field of clean energy. The aim of the European Union is to put energy efficiency first and pave the way for renewable energy which is driving change in global markets, and ensure fair treatment for consumers. The latter are key players in the energy markets of the future. All these changes call for greater flexibility of markets and change of existing national legislations. The central objective of energy policy is reliable, sustainable and competitive energy which is fundamental to the economy of each Member State of the European Union and its citizens. The European Union energy policy has outlined common guidelines reflected in uniform legislation and common energy and climate goals. Pursuant to Directive 96/92/EC, the National Assembly of the Republic of Slovenia adopted the Energy Act by which Slovenia undertook to adapt its electricity industry to European guidelines. The master's thesis analyses the development of European energy legislation and presents the changes and novelties set out in the new winter package "Clean Energy for All Europeans". Further on it determines how the package will affect Slovenian energy regulations. In this context, it also deals with the European Union's and Slovenia's energy policies and the regulation of the Slovenian energy system, focusing mostly on electricity. The final part of the thesis turns to consumer protection regimes and the work of regulators in the energy market.
