Title:Zgodovinski razvoj in vrste vpisov v zemljiško knjigo : magistrsko delo

Abstract:Namen zemljiške knjige je javna objava pravnega stanja v zvezi z nepremičninami, saj dobiva v našem pravnem okolju mesto in vlogo, kot si jo zasluži. Dobro poznavanje zemljiškoknjižnega in nepremičninskega stvarnega prava postaja čedalje pomembnejše pravno področje. Nepremičnine so v današnjem času zagotovo tako pomembne dobrine, da je posamezna pravna opravila v zvezi z nepremičninami dobro zaupati le najpomembnejšim poznavalcem tega pravnega področja. Vendar je nepremičnina oziroma že sama zemlja imela v času naših prednikov pomembno vlogo oziroma je bila njihovo najpomembnejše bogastvo. Področje zemljiškoknjižnega prava, kot ga poznamo sedaj, ima korenine že v času starega Egipta, kjer so na deščice zabeležili imena zemljišč ter njihove lastnike. Prav to so tudi odkrili pri starih Grkih. Le Rimljani so bili tisti, ki niso poznali zemljiške knjige. Vendar so kljub njenemu nepoznavanju vodili nekakšen seznam oziroma listino zemljišč. S tem pa se izkazuje, kako zelo je bila pomembna zemljiška knjiga za takratno civilizacijo. Za slovensko pravno področje najdemo zemljiškoknjižne pravne korenine v starem zemljiškoknjižnem sistemu germanskega izvora. Kljub sprejetju novih zemljiškoknjižnih predpisov ohranjamo v osnovi tradicionalen način vodenja zemljiške knjige in temeljna načela, na katerih sloni zemljiškoknjižno pravo. V magistrskem delu smo poleg odkrivanja zgodovine nastanka zemljiške knjige prikazala tudi osnove zemljiške knjige, vrste vpisov v zemljiško knjigo ter stvarne in obligacijske pravice. Glavna oblika vpisov v zemljiško knjigo so vknjižba, predznamba in zaznamba. Pomožna vpisa pa sta poočitev in plomba. Lastninska pravica je v Republiki Sloveniji ena izmed osnovnih človekovih pravic in je ustavno varovana kategorija.

Abstract:The purpose of the land register is to publicly announce the legal status of the real estate and it is getting the deserved role and position in our legal environment. A good knowledge of the land registry and real estate law is becoming an increasingly important area of law. Nowadays, real estate is certainly an important asset that certain legal tasks in relation to real estate should be trusted only to the most important experts in this legal area. However, the real estate, or the land itself, played an important role in the past as they were the most important asset of our ancestors. The field of the land law, as we know it today, has its roots in the time of ancient Egypt, when the names of the land and their owners were written in the scripts. The ancient Greeks were doing the same thing. But the ancient Romans were those who were not so familiar with the land registry. However, in spite of the lack of knowledge regarding to the land registry, they had some sorts of lists similar to the land register. This procedure shows how important the land register was to them. In the Slovenian legal area, the land register legal roots are found in the old land registry system of German origin. Despite the adoption of the new land registry regulations, we are preserving the traditional way of managing the land register and the basic principles which are the basis of the land law. In the master's thesis, we are writing about the history of the creation of the land register, we have also described the basics of the land register, the type of entries in the land register, and the real and obligatory rights. The main forms of the land register enteries are the entry, the preliminary note and the note. The auxiliary entries are additional entry andnotice of peding action. The right to property is one of the basic human rights in the Republic of Slovenia and it is a constitutionally protected category.
