Title:Prepoved uporabe kemičnega orožja : Sirija - prizorišče hudodelstev zoper človeštvo

Abstract:Po odmevajočih besedah "nikoli več" po genocidu v Srebrenici se pod žarometi mednarodnih medijev ponovno bije ena izmed največjih humanitarnih kriz v zadnjih letih, kjer je bilo, med vsesplošnim kršenjem mednarodnega prava, uporabljeno tudi kemično orožje. Namen magistrskega dela je preučiti, zakaj - ob tako resnih kršitvah mednarodnega prava in človekovih pravic - v več kot osmih letih ni prišlo do uspešnega posredovanja mednarodne skupnosti. V magistrskem delu bo zato predstavljena (ne)uporaba doktrine dolžnosti zaščititi in z njo povezani razlogi za skoraj popolno ohromitev mednarodne skupnosti, ki tudi ob trdnih dokazih, da je bilo v Siriji uporabljeno prepovedano kemično orožje, situacijo zgolj nemočno opazuje. To pa čedalje bolj "spodkopava" verodostojnost za mir vzpostavljene organizacije Združenih narodov. V nalogi bo prikazano tudi, kaj vse se skriva za "večnimi veti" Rusije in Kitajske na vsak predlog, ki bi lahko potencialno končal nasilje v Siriji. S pomočjo analize in interpretacije bo opisan nastanek in potek državljanske vojne, z deskriptivno metodo pa bo, na podlagi različnih mednarodnopravnih aktov, analiziran pojem kemičnega orožja, njegovega učinka in njegove prepovedi uporabe ter delovanje organizacije za prepoved kemičnega orožja. Z aksiološko metodo bo nato opredeljena tudi vloga mednarodne skupnosti pri (ne)reševanju sirske krize in kaznovanju odgovornih. Pričakujem, da bo obravnavana tematika pripomogla k celovitemu razumevanju krize v Siriji in nemoči mednarodne skupnosti pri obravnavi in reševanju množičnih kršitev, vključno z uporabo prepovedanega kemičnega orožja.

Abstract:After the genocide in Srebrenica and the resounding words "never again", the international media spotlight once again follows one of the biggest humanitarian crises in recent years where chemical weapons have been during widespread violation of international law. The purpose of this work is to ask ourselves why - in the face of such serious violations of international law and human rights - there has been no successful intervention by the international community in more than eight years. This Master's thesis will explain the (non)application of the Responsability to protect doctrine and the related reasons for almost complete paralysis of the international community, which, even with strong evidence that banned chemical weapons have been used in Syria, only helplessly observes the situation. This is increasingly "undermining" the credibility of the peace-building United Nations Organization. It will also show what lies behind the "never-ending vetoes" of Russia and China on any proposal that could potentially end violence in Syria. Using analysis and interpretation, I will describe the emergence and course of the civil war. I will also use descriptive method to describe the concept of chemical weapons, its impact and prohibition of use, and the functioning of the Organization for the Prohibition of Chemical Weapons. Axiological method will be used to define the role of the international community in solving - or not - the Syrian crisis and punishing those responsible. I expect that the discussed subject will contribute to a comprehensive understanding of the Syrian crisis and the inability of the international community to address and resolve mass violations, including the use of banned chemical weapons.
