Title:Problemi pridobivanja zemljišč za ceste na nivoju lokalne skupnosti : magistrsko delo

Abstract:Magistrsko delo obravnava perečo problematiko, s katero se tako na ravni občin kot na ravni države vsakodnevno srečujemo. Gre za urejanje zemljiškoknjižnega lastništva zemljišč, po katerih že več desetletij potekajo javne ceste. Zadnjih tridesetih let prejšnjega stoletja, katerega temelj je bila družbena lastnina, se z urejanjem lastništva takih zemljišč niso veliko ukvarjali. Pomembno je bilo le, da so se ceste gradile. Ker pa je lastninska pravica kot ena izmed temeljnih človekovih pravic varovana z ustavo, imamo na občini dve možnosti pridobivanja takih zemljišč, in sicer odkup ali pa uvedbo postopka razlastitve. Pri sklenitvi sporazumnega pravnega posla je postopek enostaven. Ko pa se stranki ne moreta sporazumeti, je treba uvesti razlastitveni postopek. To je poseg v lastninsko pravico, ki se ga v praksi raje izogibamo. Za njegovo uvedbo morata biti zadoščena dva pogoja, da je takšen poseg v lastninsko pravico nujno potreben in da je poseg tudi v sorazmerju z lastninsko pravico. Pri reševanju zaostalih zadev se vedno postavlja vprašanje, kakšna je pravična odškodnina, s katero bi bili obe stranki zadovoljni ali je to ocenjena vrednost, posplošena vrednost, orientacijska vrednost ali nekaj vmes. Občine se kompleksnosti problematike zavedajo, vendar je težava v visokih stroških, ki jih reševanje zaostalega stanja prinaša, predvsem zato, ker morajo sredstva namenjati tudi obnovi obstoječih cest ter realizaciji novih investicij, nujno potrebnih za razvoj občine. K dodatnim težavam in dolgotrajnemu reševanju zadev pa prispeva tudi velika razdrobljenosti zakonski določb tega področja v več različnih zakonih.

Abstract:The master's thesis deals with very pressing issues with which we meet daily at the level of municipalities and the state level. It is about the regulation of land register ownership of land, where public roads have been running for decades. In the last thirties of the last century, when social ownership prevailed in our system, they did not deal much with ownership regulation. The emphasis was on the fact that roads were built. However, since the property right as one of the fundamental human rights is protected by the Constitution, the municipality has only two possibilities for acquiring such land i.e., buying or introducing an expropriation procedure. When concluding a compromised legal transaction, this procedure is very simple. Otherwise, however, when contracting parties cannot agree, an expropriation procedure is required. This is the worst encroachment on the right to property, which we prefer to avoid in practice. Two conditions must be met for its imposition: first, that such an interference with the right to property is indispensable and second that the interference is in proportion to the property right. When we resolve such cases, there is always a question as to what is the fair compensation that both parties would be satisfied with and whether this is the estimated value, the generalized market value, the orientation value, or something in between. Municipalities are aware of the complexity of the problematics. But the problem lies in the high costs related to solving the backlog, mainly because the funds must also be used for the renovation of existing roads and the realization of new investments that are indispensable for the development of the municipality. Additional problems and long-term resolution of cases apper due to the great fragmentation of the legalities of this sphere in several different laws.
