Title:Vpliv Splošne uredbe o varstvu osebnih podatkov na ustavnosodno presojo : magistrsko delo

Abstract:Magistrsko delo obravnava vpliv Splošne uredbe o varstvu osebnih podatkov na ustaljeno sodno prakso Ustavnega sodišča. Namen raziskave je z uporabo deskriptivne, analitične, sintetične in primerjalne metode uvodoma predstaviti pravico do varstva osebnih podatkov ter pravno podlago za varstvo te pravice, podrobneje analizirati Splošno uredbo o varstvu osebnih podatkov ter na podlagi preučitve sodne prakse Ustavnega sodišča povzeti ključna ustavnopravna stališča ter ugotoviti, ali vsebina Splošne uredbe vpliva na sprejeta stališča Ustavnega sodišča in na njegovo nadaljnjo presojo. Ustavno sodišče se je skozi svojo sodno prakso velikokrat ukvarjalo tudi z ustavno varovano pravico do varstva osebnih podatkov, predvsem z vidika načela zakonitosti. Posege v to pravico pa je dopustilo samo v primeru javne koristi ali varstva drugih pravic ter v kolikor so bili v skladu z načelom sorazmernosti. Splošna uredba o varstvu osebnih podatkov določa več širše opredeljenih legitimnih razlogov za dopustno omejitev te človekove pravice. Posledično bo ustavnosodna presoja v prihodnje bistveno omejena, spremenil pa se bo tudi položaj Ustavnega sodišča, predvsem z vidika zadev, o katerih bo v prihodnje le-to odločalo na tem področju. Ugotovitve raziskovanja bi lahko bile pomembne smernice za nadaljnje proučevanje tega področja v stroki, predvsem zaradi vedno večjega zavedanja temeljne pravice do varstva osebnih podatkov ter nove zakonodaje na tem področju.

Abstract:This Graduate Paper discusses the impact of the General Data Protection Regulation on the legal practice of the Constitutional Court. The aim of the research is to initially introduce the right to personal data protection and the legal bases for the protection of this right by means of the descriptive, analytical, synthetic and comparative methods, to more thoroughly analyse the General Data Protection Regulation, to summarise the key constitutional principles by studying the legal practice of the Constitutional Court, as well as to establish whether the contents of the General Regulation impacts the adopted principles of the Constitutional Court and its further assessment. Through its legal practice, the Constitutional Court has often dealt with the constitutionally protected personal data protection right, especially from the legality point of view. Infringements of this right were only allowed in the case of public benefit or the protection of other rights and only if they met the principle of proportionality. The General Data Protection Regulation stipulates several widely defined legitimate reasons for an acceptable limitation of this human right. Consequently, constitutional assessment will be significantly limited in the future. Also the position of the Constitutional Court will change, especially from the viewpoint of matters that will be decided upon in the area. The findings of the research could also be important guidelines for further studies of this professional field, especially because the awareness of the fundamental personal data protection right is growing and because of the new legislation in the field.
