Title:Alternativno reševanje sporov s poudarkom na mediaciji v delovnih sporih : diplomsko delo

Abstract:V diplomski nalogi obravnavamo alternativne načine reševanja sporov, predvsem mediacijo v delovnih sporih. Predstavljamo spor, alternativne načine reševanja sporov, mediacijo (načela, prednosti, korake), delovne spore in mediacijo v delovnih sporih. S pomočjo intervjuja želimo ugotoviti pogostost in učinkovitost mediacije na delovnih sodiščih. Odgovore smo pridobili na Delovnem in socialnem sodišču v Ljubljani ter pri odvetnici in mediatorki Zdenki Pavlovič s Ptuja. Spoznali smo, da se z mediacijo najpogosteje vodijo spori glede prenehanja delovnega razmerja oz. odpovedi pogodbe in denarni zahtevki. Prav tako smo, tudi spoznali, da je mediacija pogostejša v individualnih kot kolektivnih sporih ter da je pogostejša v zasebnem sektorju. Na delovnem sodišču so pojasnili, da v javnem sektorju v glavnem ni mediacij. Kljub temu da je raziskovalni del precej skromen glede pridobljenih podatkov ter da odzivnost sodišča in odvetnice ni bila skladna z našimi pričakovanji, nam je uspelo ugotoviti prednosti reševanja delovnih sporov s pomočjo mediacije. Obenem smo ugotovili, da je prav zadostna seznanjenost celotne splošne delovne populacije o mediacijah v delovnih sporih tista, ki lahko prispeva k povečanju števila zadev, ki se rešujejo z mediacijo. Čeprav sodišča stranke napotijo na mediacijo, menimo, da bi bili lahko rezultati rešenih zadev z mediacijo boljši, če bi imele stranke več informacij glede mediacije kot oblike alternativnega reševanja sporov.

Abstract:In this graduation thesis we dealt with alternative methods for resolving disputes, especially mediation in labour disputes. We presented what dispute, alternative ways of resolving disputes, mediation (principles, advantages, and steps), labour disputes and mediation in labour disputes are. By carrying out an interview, we wanted to determine the frequency and effectiveness of mediation in labour courts. The answers were obtained from the Labour and Social Court of Ljubljana, as well as from the attorney and mediator Zdenka Pavlovič, who is based in Ptuj. We realised that mediation is most often used both with disputes regarding employment termination or termination of the contract, as well as monetary claims. We realised that mediation is more frequent in individual rather than in collective disputes, and that it is more frequent in the private sector. It was explained from the Labour Court that there generally are no mediations in the public sector. Even though the research part is rather modest in terms of the data obtained, and that the responsiveness of the court and the attorney was not in line with my expectations, we managed to determine the benefits of resolving labour disputes through mediation. Furthermore, it was determined that sufficient knowledge of the entire general working population on mediation in labour disputes can contribute to an increase in the number of cases resolved through mediation. Although the courts refer the parties to mediation, it is believed that the results regarding mediated cases could be better if the parties were given more information about mediation as an alternative form for resolving disputes.
