Title:Terjatve upnikov v stečajnem postopku : magistrsko delo

Abstract:Magistrsko delo obravnava problematiko v zvezi s terjatvami upnikov v stečajnem postopku. Namen dela je prikazati upnikom, kako priti do poplačila svojega dolga v primeru, ko se nad njihovim dolžnikom začne stečajni postopek. S potrjeno hipotezo bo prikazana najbolj učinkovita prijava terjatev. Ob podrobnejšem opisu prijave terjatve pa so v magistrskem delu poudarjene tudi problematike, ki se pojavljajo v zvezi s terjatvami v stečajnem postopku, ter rešitve, s katerimi se je tem problematikam mogoče predhodno izogniti. Sodelovanje upnikov in stečajnega dolžnika, je v stečaju izrednega pomena, saj se le s tem izognemo morebitnim zlorabam. Stečajni zakon oz. Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju. Na podlagi zakona, ki ureja celotno insolvenčno pravo, poznamo več vrst terjatev, ki jih lahko ima upnik, kot tudi dve pravici, in sicer ločitveno in izločitveno pravico. Problematika, ki se je izoblikovala skozi obdobje, pa je predstavljena na podlagi raziskave sodne prakse, ki se nanaša na terjatev upnikov. Preizkus obsoja upnikovih terjatev opravi stečajni upravitelj in od katerega je odvisna tudi usoda terjatve upnika. Upnik v stečaj mora pravočasno prijaviti svoje terjatve ter spremljati stečajni postopek. Poleg navedenega je predstavljena tudi zakonodaja stečajnega postopka v drugih državah, iz katerih izhaja, da imajo te posamezne države zelo podobno ureditev stečaja, kot tudi skupno točko, saj večina ureditve insolvenčnega prava izhaja iz nemške insolvenčne zakonodaje.

Abstract:The purpose of the work is to show creditors how to get their debt repaid in the event that a bankruptcy proceeds against their debtor. The confirmed hypothesis will show the most effective claim filling. In addition to a more detailed description of the claim filing, the master's thesis also highlights the problems that arise in connection with claims in bankruptcy, as well as solutions that can be avoided beforehand. An important act, is the cooperation of creditors and bankruptcy debtors, as this only avoids any abuse during the bankruptcy proceedings. Slovenian insolvency law shows hot to claim filling in bankruptcy. Pursuant to the law governing all insolvency law, there are several types of claims a creditor may have, as well as two rights, namely the right of separation and exclusion. However, the issues that have emerged over the period are presented on the basis of a case-law survey on creditors' claims. The main act of the bankruptcy proceeding is the procedure for the examination of claims by the trustee in bankruptcy, on which the fate of the creditor's claim depends. It is the duty of the creditor in bankruptcy proceedings to timely file his claims and monitor the bankruptcy proceedings. In addition, bankruptcy law is presented in other countries, which shows that these individual countries have a very similar regulated area of insolvency law, as well as a common point, since most insolvency law regulation derives from German bankruptcy regulation.
