Title:Vloga Beneške komisije pri promociji demokracije skozi pravo : magistrsko delo

Abstract:Evropsko komisija za demokracijo skozi pravo ali Beneško komisijo je 10. maja 1990 ustanovil odbor ministrov Sveta Evrope. Je posvetovalni organ Sveta Evrope za ustavnopravna vprašanja. Njen temeljni akt je statut. Temeljna delovna področja so demokratičnost institucij in temeljne človekove pravice ter svoboščine; ustavno sodstvo; volitve; referendumi in politične stranke. Trenutno šteje 61 držav članic. Stalni kraj zasedanja so Benetke, medtem ko je sedež sekretariata v Strasbourgu. Komisija se sestaja štirikrat letno na plenarnem zasedanju. Sestavljata jo po en član ter nadomestni član iz vsake države članice in sta imenovana za dobo štirih let. Gre za neodvisne strokovnjake z mednarodnimi izkušnjami pri delovanju v demokratičnih institucijah. Predsedstvo Komisije se izvoli izmed vseh članov za obdobje dveh let. Glavna dejavnost Beneške komisije je priprava mnenj v skladu z njenimi pooblastili na zahtevo države članice, organov Sveta Evrope in mednarodne organizacije. Mnenja niso pravno zavezujoča, vendar predstavljajo določen pravni standard za državo. Mnenja imajo pomemben vpliv na delovanje Evropskega sodišča za človekove pravice, saj to v svojih sodbah pogosto citira mnenja Komisije. Raziskovalne metode, ki sem jih uporabila, so zgodovinska metoda, primerjalna metoda, metoda analize, induktivna metoda in metoda študije primera.

Abstract:The European Commission for Democracy through Law or the Venice Commission was established on 10 May 1990 by the Minister of the Council of the Council of Europe. It is a advisory body on constitutional matters of the Council of Europe. Its basic act is the Statute. The Commission fundamental work areas are: democratic institutions and fundamental rights; constitutional justice and elections, referendums and political parties. The Commission has 62 member states. Its plenary sessions are held in Venice, four times a year. Meanwhile its permanent secretariat is located in Strasbourg. The members of the Commission are independent experts with international experience in working in democratic institutions. The members and alternate member are appointed for four years by the participating countries. The Bureau of the Commission shall be elected from among all its members for a term of two years. The main activity of the Venice Commission is to prepare opinions in accordance with its mandate at the request of a Member State, Council of Europe bodies and an international organization. Opinions are not legally binding, but they do set a legal standard for the country. Opinions have a significant impact on the functioning of the European Court of Human Rights, as it often cites Commission opinions in its judgments. The research methods used by such historical method, comparative method, analysis method, inductive method in the case study method.
