Title:Izvensodno reševanje delovnih sporov : magistrsko delo

Abstract:Magistrska naloga obravnava oblike izvensodnega reševanja delovnih sporov. Ker so delovni spori del vsakdanjega življenja, se jim ni moč izogniti. V delovnem okolju prihaja do raznih nesoglasij in konfliktov med delavcem in delodajalcem, kar vodi do nastanka različnih delovnih sporov. Da bi spore zatrli že v začetni fazi, se poskušajo rešiti s konstruktivnimi pogovori. Če niso bili uspešni, lahko posreduje tretja oseba v postopkih mirnega reševanja sporov. Če se udeleženci spora niso uspeli sporazumeti in soglasja ni bilo možno skleniti, se udeleženci spora še vedno lahko poslužujejo tradicionalnih oblik na sodišču. Poznamo več možnosti izvensodnega reševanja delovnih sporov, med najbolj pogostimi je seveda mediacija. Prednosti mediacije pred sodnim načinom reševanja delovnih sporov so predvsem v njeni hitrosti, nižjih stroških, in ker temelji na prostovoljnosti, zaupnosti in fleksibilnosti postopka. Po opravljenih raziskavah do spora pride predvsem iz razlogov izrednih odpovedi pogodbe o zaposlitvi, sporov zaradi denarnih terjatev, zaradi plače, regresa, odškodnine zaradi neizkoriščenega dopusta in drugih razlogov. Izvensodno reševanje delovnih sporov se v Sloveniji in tudi v tujini uporablja predvsem z namenom, da se dosežejo manjše obremenitve sodišča in zmanjšajo sodni pripadi. Predvsem pa zaradi tega, ker so možnosti mirnega reševanja sporov ljudem veliko bolj prijazne oblike kot sodno reševanje.

Abstract:The master's thesis deals with forms of out-of-court work dispute resolution. Since labor disputes are part of everyday life, they can not be avoided. There are various disagreements and conflicts between the worker and the employer in the working environment, which leads to the creation of various labor disputes. In order to suppress the conflicts at an early stage, they try to solve them through constructive discussions. If they have not been successful, a third party may intervene in a peaceful dispute settlement procedure. If the participants in the dispute failed to reach agreement and the agreement could not be concluded, the participants in the dispute can still use traditional forms in court. There are several possibilities of out-ofcourt settlement of labor disputes, of course the mediation is one of the most frequent ones. The advantages of mediation before the judicial way of resolving labor disputes are primarily at its speed, lower costs, based on volunteering, confidentiality and flexibility of the procedure. After the research is conducted, the dispute arises mainly for reasons of extraordinary termination of the employment contract, disputes arising from receivables due to salary, recourse, compensation for unused leave and other reasons. Out-of-court settlement of labor disputes in Slovenia and abroad is mainly used with a view to achieving a lower burden on the court and reducing court case. Above all, because the possibilities of peaceful settlement of disputes are far more friendly to people than judicial solution.
