Abstract:Diplomsko delo povzema osnovne značilnosti predporočne pogodbe, kar je pogovorni izraz za pogodbo o urejanju premoţenjskih razmerij med zakoncema, ki je v slovenski pravni prostor vstopila z aprilom 2019. Skozi kratek zgodovinski oris je najprej prikazan razvoj instituta ter splošna ureditev premoţenjskih razmerjih med zakoncema skozi čas. Primerjava z ureditvijo v izbranih drţavah pa pokaţe, da ima ta institut lahko še več uporabnih funkcij, kot mu jih dopušča trenutna slovenska ureditev. Opravljena je tudi primerjava med prejšnjo in sedanjo ureditvijo premoţenjskopravnih razmerij v Republiki Sloveniji, podrobneje pa so predstavljene še določbe, ki se nanašajo na pogodbeni premoţenjski reţim. Nadalje je predstavljen še register pogodb in dejanski način hrambe dokumentacije. V zvezi z vsebino so postavljene hipoteze, ki so obravnavane v zaključku diplomske naloge. Glavni vir informacij je predstavljala analiza strokovne literature, zakonodajnih aktov ter praktičnih primerov na obravnavanem področju. Kot glavna raziskovalna metoda je tako sluţila deskriptivna metoda. Osrednji namen naloge je predstaviti osnovne značilnosti instituta predporočne pogodbe in bralcu prikazati glavne razlike med laično pričakovanimi lastnostmi ter dejansko pravno ureditvijo in tako prikazati dejanski pomen in uporabnost instituta. Opravljena primerjava s prej veljavno ureditvijo ter z nekaj izbranimi drţavami pa pokaţe, da slovenska ureditev končno sledi v svetu ţe uveljavljenim trendom na področju urejanja premoţenjskopravnih razmerij med zakoncema, četudi s počasnejšim in bolj previdnim tempom.

Abstract:The thesis summarizes basic characteristics of the prenupital agreement, the expression most often publicly used in Slovenia for a contract, regulating property relations between spouses (i.e. nuptial agreement), which has been a part of Slovenian legal system since April of 2019. A brief historic outline shows the evolution of the nuptial agreement and of the general legal system regarding property relations between spouses through time. Comparison between the systems of chosen countries shows there is still a lot more options to explore its purpose and usage than it is currently allowed in Slovenia. Additionally, a comparison between previous and current legal regulation of property relations between spouses was made. The provisions relating to the contractual property regime are presented in more detail. Furthermore, the nuptial agreement registry and the actual method of storing the documentation are presented. Regarding the content, hypotheses are raised and discussed in the conclusion of the thesis. The main source of information was the analysis of professional literature, legislative acts and practical examples in the field. The descriptive method thus served as the main research method. The main purpose of the thesis is to present the basic characteristics of the prenuptial agreement and to demonstrate the actual legal regulation and usefulness of said agreement. Comparison with the previous regulation in Slovenia and between a few selected countries shows that Slovenian legislation is finally following the already established trends in the field of matrimonial property regulation, even if at a slower and more cautious pace.
