Title:Imuniteta diplomatskih in konzularnih prostorov v luči primera Khashoggi : magistrsko delo

Abstract:Države so že od antičnih časov priznavale poseben status tujih predstavnikov, zato so nekatera temeljna načela, ki se nanašajo na take predstavnike in prostore, v katerih delujejo, kot na primer nedotakljivost diplomatskih prostorov, stare kot prve civilizacije. Od takrat se je diplomatsko pravo nenehno razvijalo in spreminjalo, vendar so bistvena načela preživela ta razvoj. Pravila diplomatskega prava se nanašajo na vse države, saj ga le-te uporabljajo vsak dan v odnosih med seboj. Pravila diplomatskega prava so bila v veljavi že veliko pred sprejetjem temeljne kodifikacije Dunajske konvencije o diplomatskih in konzularnih odnosih. Nedavni dogodki so pokazali tendenco diplomatov in konzulov, da ne upoštevajo zakonodaje države sprejemnice, in tendenco k uveljavljanju diplomatske imunitete, da bi se izognili odgovornosti za storjena dejanja. Diplomatska imuniteta ima močan temelj, vendar morajo razlogi za njeno upravičenje biti uravnoteženi s potrebo po preprečevanju diplomatskega kriminala in potrebo po zaščiti pravic žrtev. Tako prihaja do kršitev diplomatske imunitete, ki posledično pomenijo kršitev mednarodnega prava. Problematika imunitete diplomatskih in konzularnih prostorov je prikazana na primeru umora novinarja Jamala Khashoggija. Novinarja in kritika savdske oblasti so ubili v konzularnih prostorih Savdske Arabije v Turčiji. Gre za hudo kaznivo dejanje storjeno v konzularnih prostorih, s strani oseb, ki naj ne bi bile varovane z diplomatsko imuniteto. Usmrtitev Khashoggija je pomenila vsaj tri različne kršitve mednarodnega prava. Zaskrbljujoče je, da je uboj Khashoggija doslej povzročil malo učinkovitih mednarodnih odzivov, bodisi pravnih, političnih ali diplomatskih. Pojavi se vprašanje, ali obstajajo učinkoviti mehanizmi za sankcioniranje kršitev diplomatskih imunitet.

Abstract:Countries have recognized the special status of foreign representatives since ancient times, so there are some fundamental principles that apply to such representatives and the premises in which they operate, such as the inviolability of diplomatic premises as old as the first civilization. Since then, diplomatic law has been constantly evolving and changing, but essential principles have survived this development. The rules of diplomatic law apply to all countries, as they are applied daily in relations with each other. The rules of diplomatic law were in place long before the fundamental codification of the Vienna Convention on Diplomatic and Consular Relations was adopted. Recent events have shown a tendency of diplomats and consuls to disregard the law of the receiving country and a tendency to exercise diplomatic immunity in order to avoid being held accountable for acts committed. Diplomatic immunity has a strong foundation, but the reasons for its justification must be balanced by the need to prevent diplomatic crime and the need to protect the rights of victims. In this way, violations of diplomatic immunity occur, which in turn constitute a violation of international law. The issue of the immunity of diplomatic and consular posts is illustrated in the case of the murder of journalist Jamal Khashoggi. Saudi authorities reporter and critic was killed in Saudi Arabian consular posts in Turkey. It is a serious crime committed on consular premises by persons who are not supposed to be protected by diplomatic immunity. Execution of Khashoggi amounted to at least three different violations of international law. It is worrying that the killing of Khashoggi has so far produced little effective international response, whether legal, political or diplomatic. The question arises whether there are effective mechanisms for sanctioning violations of diplomatic immunities.
