Title:Reševanje sporov, ki vplivajo na družino s pomočjo mediacije : diplomsko delo

Abstract:Slovenska sodišča so leta 2001 začela alternativno reševanje sodnih sporov in s tem zmanjšala preobremenjenost sodišč. Strankam ponujajo mirno rešitev spora z mediacijo. Poznamo različne oblike mediacij, ki se izvajajo na različnih področjih, to je na družinskem, delovnem, civilnem in gospodarskem pravu. Najbolj pogost družinski spor je razveza zakonske zveze, ki ima večkrat negativne posledice za otroke, saj so ti najbolj ranljiva skupina. V tovrstnih sporih velikokrat nastopajo močna čustva med zakoncema. Razveza zakonske zveze staršev je zelo težka in mučna življenjska izkušnja tako za starša, posebno pa še za otroke. Največkrat se zgodi, da v takih situacijah starši pozabijo na najboljši interes svojega otroka. Kako se bo otrok v takih situacijah prilagodil, je najbolj odvisno od tega, kakšno komunikacijo bosta starša uporabila po razvezi zakonske zveze. Največje darilo, ki ga razvezani starši lahko dajo svojemu otroku, je to, da nadaljujeta normalno komunikacijo in odnos z drugim staršem, čeprav sta bila neuspešna pri ohranitvi zakonske zveze. Ravno zaradi tega bi morala starša, ki sta sedaj stranki v postopku, bolje poznati postopek mediacije. Mediacija v družinskih zadevah ključnega pomena, saj je njen namen vzpostavitev komunikacije med staršema in ohranitev zdravega odnosa v njihovem nadaljnjem življenju, ki je ključen za ustrezen psihofizičen razvoj otroka. Diplomsko delo predstavi uporabo mediacije skozi DZ. Skozi dobre prakse ter novo normativno ureditev lahko pričakujemo večjo sprejetost uporabe mediacije kot mehanizma reševanja družinskih sporov.

Abstract:Slovenian courts began with the practice of alternative dispute resolution procedures in 2001. It is a successful way of offering a peaceful solution for all parties, through mediation. However, there are various forms of mediation, implemented in various fields like family law, labor law, civil law and commercial law. One of the most common family disputes is divorce, often causing negative consequences for children, as they are the most vulnerable group. There are often strong emotions between spouses in such disputes. Divorce is a very difficult and painful experience not only for parents but also for their children. In such situations parents often forget to consider the solution that would affect their children as little as possible. How the child will respond to the divorce depends on the parents% relationship after separation. The greatest gift for the child is when their divorced parents try to maintain normal communication and peaceful relationship between them, even though their marriage was unsuccessful. Mediation in family matters is very important, because it can improve communication between divorced parents and establish a healthy relationship, which is crucial for a healthy physical and mental development of their child. The thesis is representing the use of mediation trough the Family Code. Therefore, parents, who are now parties to the proceedings, should be much more aware of what mediation is and why it should be used more often to become generally accepted.
