Title:Pravica do človekovega dostojanstva v procesu umiranja : doktorska disertacija

Abstract:V ospredje je postavljena obravnava vprašanja človekovega dostojanstva v obdobju ali procesu človekovega umiranja. Namen disertacije je predstaviti moralno-etične dileme, ki nastanejo v procesu umiranja, kakšen odgovor na to vprašanje trenutno nudi pravni red ter ali se stališče družbe odraža v trenutnem pravnem redu. Uvodna poglavja so namenjena predvsem predstavitvi pojma dostojanstva ter njegovi umeščenosti v različne pravne dokumente. Obravnavana tematika posega tudi na nekatera druga znanstvena področja, zato so v nadaljevanju dela predstavljena še določena vprašanja medicinske in zdravstvene znanosti, ki se tičejo zlasti definiranja začetka procesa umiranja. Slednja so predstavljena tudi v tistih delih, kjer se pri obravnavi posameznega predmeta srečujejo ali sovpadajo s pravno znanostjo. Glede na postavljene hipoteze je bilo uporabljenih več raziskovalnih metod. Na tej podlagi so v delu predstavljena vprašanja pravice do življenja ali pravice do smrti, predstavljene so nekatere bolj izpostavljene moralno-etične dileme, obravnavane so različne oblike pomoči, ki skrajšajo življenje, obsežno poglavje je namenjeno predvsem vsebini paliativne oskrbe. Z različnih vidikov je predstavljena pravna ureditev v Sloveniji, posebno poglavje je namenjeno nekaterim odmevnim in zanimivim primerom iz sodne prakse, primerjalnopravnemu pregledu nekaterih evropskih ureditev kot tudi ureditev iz drugih držav sveta. Z raziskavo, ki je predstavljena v zadnjem delu, pa se je zasledoval zlasti cilj predstaviti odnos naše družbe do zastavljenega vprašanja, razmišljanja ljudi različnih poklicev oz. različnih strok o zastavljenem vprašanju ter poskus ozaveščanja predvsem tistih skupin ljudi, ki lahko dosežejo spremembe obstoječe zakonodaje, da zagotovijo boljše pogoje pacientom v procesu umiranja, ki se mu nihče ne more izogniti.

Abstract:Issues of human dignity are in the forefront of this doctoral dissertation, especially in the period or process of human dying. The purpose is to present the moral dilemmas that arise in the process of dying, what answer to this question currently provides the law and whether society's opinion reflects in the current legal frame. The aim of introductory chapters is primarily to present the concept of dignity and its placement in different legal documents. Some questions in this work also affect other scientific areas like medical and health sciences, which are also presented in the work, in particular regarding the definition when a dying process starts. These scientific areas are also presented in other parts where they face or coincide with legal science. According to the hypotheses several research methods were used. There are also presented questions about the right to life or right to death, some more exposed moral dilemmas, and various forms of assisted dying. Special chapter is intended to present the content of palliative care. The Slovenian legal frame is presented from various aspects and a specific chapter is aimed for some of the high-profile cases in case-law, comparative review of different European state legislations as well as legislations from other countries in the world. The survey, which is presented in the last part, followed in particular to present the relationship of our society about the question referred, reflection of various profiles regarding the question referred and to attempt awareness to those groups of people, who can achieve changes to existing legislation to ensure better conditions for patients in the process of dying, which no one can avoid.
