Title:Sistem financiranja občin v Sloveniji : povprečnina in obvezne naloge

Abstract:Občina potrebuje za uresničevanje svojega bistva priznavanje samostojnosti in neodvisnosti ter sistem, ki ji to omogoča. Pomembna je jasna razmejitev nalog, ki so lokalne narave od tistih, ki izhajajo iz državne ravni. V nadaljevanju pa se naloge lokalne narave razmejujejo na obvezne in neobvezne naloge. Vsakršna razmejitev nalog privede do dvoma, v kolikor razmejitev nalog ni jasno določena s predpisi in v kolikor nima jasne slike o tem, kako so takšne naloge financirane. S proučevanjem državnih predpisov prišli do ugotovitve, da obstaja nejasna slika o tem, katere občinske naloge so obvezne in katere neobvezne. Prav tako je predpisov, ki govorijo o nalogah občin, preveč. Pomanjkljivost pa se kaže v tem, da se Zakon o lokalni samoupravi, ki sicer določa izvirne naloge občin, ne upošteva kot krovni zakon, ki bi te naloge povezal v neko smiselno celoto. Novo razmejevanje občinskih nalog pa je uvedel tudi Zakon o financiranju občin, ki je v svojih določbah določil naloge, ki se financirajo s primerno porabo. Z analizo nalog in sredstev za njihovo financiranje na konkretnem primeru Občine Poljčane smo prišli do ugotovitve, da povprečnina, ki je izračunana iz povprečnih stroškov obveznih nalog občin, ki jih določa Zakon o financiranju občin, ni odraz dejanskega stanja in posledično privede do nesorazmerja med obveznimi nalogami občin ter sredstvi za njihovo financiranje. Trenutno veljavni sistem financiranja občin pa pozablja, da ima občinska infrastruktura rok trajanja in samo vzdrževanje ne more zagotavljati kakovosti življenja občanov. Čigava naloga so torej investicije? In čigava naloga je zagotavljanje socialne varnosti?

Abstract:Municipality need for achieving their essence recognition of autonomy, independency and furthermore the system that enables all of that. First, we must distinguish between assignments that are based on local level and the ones that are governmental based. Continuing, local assignments are divided on optional and mandatory levels. Any division of assignments can lead to the doubt, if the tasks are not separated clearly and determined with the official regulations or clear financial flow. With the studying of government%s regulation, we understood that there is a blurred line of which municipality%s assignments are mandatory and which ones are optional. There are too many regulations which speak of the municipalities% tasks and obligations. Deficiency is shown in the fact that the Local self % government act, which is in determination of original assignments of the municipalities, is not considered as the main law to connect all of those tasks into a meaningful whole. The new delimitation of municipal tasks was also introduced by the Financing of municipalities act, which determined the tasks financed with appropriate spending. With the analysis of the assignments and founds for their financing on the case of municipality Poljčane, we came to the conclusion that the lump sum, which is calculated from the average costs of obligatory task, that are determined by the Financing of municipalities act, is not the reflection of the actual state and can lead to a disproportion between mandatory tasks of municipalities and funds for their financing. The current municipal financing system, however, is forgetting that municipal infrastructure also has shelf life, and maintenance alone cannot guarantee the quality of life of its citizens. Whose task is taking care of the investment? And whose task is to provide social security?
