Title:Socialna država v primežu med aktivno državo in tržno konkurenco : magistrsko delo

Abstract:Cilj magistrskega dela je predstaviti odnos med socialno državo, njeno aktivno funkcijo in tržno konkurenco. Magistrsko delo pri raziskovanju obravnavane teme uporablja interdisciplinarni pristop, ki združuje področje prava, politične ekonomije, antropologije, zgodovine in sociologije. V prvem delu so razčlenjeni trije temeljni pojmi, ki izhajajo iz naslova. Predstavljena je normativna pravna ureditev ekonomskih in socialnih pravic tako na nacionalni kot tudi na regionalni in mednarodni ravni. Aktivna funkcija države je predstavljena ozko in širše. Ožja opredelitev aktivne države se nanaša na aktivne politike zaposlovanja, medtem ko širša definicija zaobjema pozitivne obveznosti države in relevantno sodno prakso Ustavnega sodišča. Predstavljeni so tudi različni modeli socialne države in lastnosti vsakega izmed njih. Tržno konkurenco magistrsko delo obravnava skozi glavne ekonomske teorije. Posebno pozornost delo namenja notranjim in zunanjim pritiskom na socialno državo, skozi katere prikaže odnos socialne države do aktivne funkcije države in tržne konkurence. Notranje pritiske obravnava kot družbene spremembe v zahodnem modelu družbe, zlasti skozi demografske spremembe in posledice, ki jih te spremembe prinašajo za različne modele socialne države. Zunanji pritiski so predstavljeni z globalizacijo in evropsko integracijo, ki od nacionalne države zahtevata, da se odpoveduje delu svoje tradicionalne suverenosti in avtonomije. Preko zunanjih in notranjih pritiskov so izpeljane posledice za socialno državo. Kot glavna posledica notranjih pritiskov se kaže dualizacija družbe in trga delovne sile, medtem ko so glavne posledice zunanjih pritiskov predstavljene skozi sodno prakso Sodišča Evropske unije. Odnos med socialno državo in tržno konkurenco je na koncu predstavljen na primeru medkrajevnih avtobusnih prevozov v Sloveniji.

Abstract:This master thesis aimed to present the relationship between the welfare state, the state's active role, and market competition. The research was conducted by using an interdisciplinary approach combining different scientific fields, such as law, political economy, anthropology, history, and sociology. In the first part, we classified three main concepts from the title. The regulatory framework on economic and social rights was presented, ranging from national, regional to international level. The active role the State was explained twofold. Firstly, its narrow definition was focused on the state's involvement in labor market policies. Secondly, its wider definition aimed at the positive obligations of the state and was focused on relevant the Constitutional Court's case law. Different models of the welfare state were also explained. Market competition was addressed by explaining the most important economic theories. Particular attention was paid to the internal and external pressures on the welfare state, through which the relation of the welfare state towards the active function of the state and market competition was explained. Internal pressures were perceived through changes in the Western model of society, especially through demographic changes and the consequences that these changes bring for different models of the welfare state. External pressures were presented with concepts of globalization and European integration. We argued that external and internal pressures bear certain implications for the welfare state. Dualization of the labor market appears as the main consequence of internal pressures, while the main consequences of external pressures are presented through ECJ's case law.
