Title:Ustavni sistemi enklav : magistrsko delo

Abstract:Enklava je del ozemlja, ki je obkroţen z ozemljem druge drţave. Poznamo več vrst enklav, in sicer razdelimo jih lahko v tri glavne skupine: enklave kot suverene drţave, nesuverene enklave in enklave na drţavni ravni. Vsaka skupina enklav se še naprej deli v podskupine. V magistrskem delu je več poudarka na suverenih enklavah, ki pa jih tudi ni veliko. Na svetu je samo šest takšnih drţav: Kraljevina Lesoto, San Marino, Vatikanska mestna drţava, Gambija, Sultanat Brunej in Kneţevina Monako. Poleg instituta enklav magistrsko delo obsega tudi ustavne sisteme teh drţav. Omeniti pa je treba še izraz eksklava. Eksklava je ozemlje, obkroţeno z ozemljem dveh tujih drţav. Izrazov med seboj ne moremo enačiti, ker obstajajo nekateri primeri, kjer ne moremo uporabiti obeh izrazov. V veliki večini primerov je isto ozemlje enklava v razmerju do tuje drţave, ki jo obkroţa, in hkrati tudi eksklava v razmerju do svoje matične drţave. Odvisno je le od tega, kateri odnos ţelimo izpostaviti. Če imamo v mislih razmerje z matično drţavo, gre za eksklavo, če pa imamo v mislih razmerje s tujo drţavo, gre za enklavo.

Abstract:The enclave is part of a territory that is surrounded by the territory of another country. There are several types of enclaves, which can be divided into three main groups: enclaves as sovereign states, non-sovereign enclaves and enclaves at the state level. Each group of enclaves continues to be subdivided into subgroups. There is more emphasis on sovereign enclaves in the task, which, however, there are only six such countries in the world: the Kingdom of Lesotho, San Marino, the Vatican, the Gambia, the Sultanate Brunei and the Principality of Monaco. In addition to the institute of enclaves, the master's thesis also includes the constitutional systems of these countries. It is also necessary to mention the term exclave. The exclave is surrounded by the territory of two foreign countries. The terms can not be equated with each other because there are some cases where we can not use both terms. In the vast majority of cases, the same territory is the enclave in relation to a foreign country that is surrounded by it, and at the same time it is an exclave in relation to its mainland. It depends only on which relationship we want to highlight. If we have in mind the relationship with the mainland, it is an exclave, if we have in mind the relationship with a surrounding state, it is an enclave.
