Abstract:Nepal je država, ki leži med Indijo in Kitajsko, bila je zadnje hindujsko kraljestvo, ki je z državljansko vojno in velikimi političnimi spremembami postala Zvezna demokratična republika Nepal. Federativna, demokratična, sekularna država Nepal je z razglasitvijo ustave Nepala 2015 (2072) predstavila moderno in svojevrstno ustavo. Diplomsko delo je nastalo z raziskovanjem in pridobivanjem različnih virov ter primerjavo ustave z drugimi ustavami. Cilj naloge je spoznati ustavo Nepala 2015 (2072) in primerjati njeno vsebinskost z drugimi obstoječimi ustavami ter tako izluščiti posebnosti oziroma razlike. Ustava, ki združuje različne kulture, veroizpovedi, tradicije, drugačnost in skrbi za pravice tudi šibkejših in manjšinskih skupnosti. Nepalska je posebna zaradi svoje vsebine, obsega pravic in razsežnosti. Ustava je snovana v sodobnem času in vključuje tako novodobne prvine kot tudi starodavne tradicije in kulture. Nepal je 20. septembra 2015 razglasil novo ustavo, ki daje zgled in odpira nova vprašanja glede vsebine. Poudarjanje pravic manjšin, otrok, invalidov, starejših, nasploh šibkejših skupin in žensk še ni bilo tako izpostavljeno kot v ustavi Nepala. Njena posebnost je vključevanje sodobnih norm z združevanjem tradicije in kulture ter zagotavljanja velike mere pravičnosti in vključevanja.

Abstract:Nepal is a country, which lays between India and China; it was the last remaining Hindu kingdom, which, with a civil war and big political changes, became the Federal democratic republic of Nepal. The federal, democratic, secular state of Nepal, which with the promulgation of the Constitution of Nepal 2015 (2072), presented a modern and peculiar constitution. This diploma thesis is a result of obtaining and researching various sources and comparing the Nepali constitution with other constitutions. The aim of the thesis is to get to know the constitution of Nepal 2015 (2072) and to compare its content with other exiting constitutions, and thus to extract specifics and differences. The constitution that combines different cultures, religions, traditions, diversities and takes care of the rights of the weaker and marginal communities. The Nepali constitution is special, because of its content, scope of the rights and its extent. The constitution that was designed in the modern times and includes modern elements, as well as ancient traditions and cultures. Nepal has on the 20th of September 2015 promulgated a new constitution, an exemplary constitution that raises new questions about the constitutional content. Emphasising the rights of minorities, children, disabled, elderly, generally weaker groups of society and women, has not yet been as highlighted as in the constitution of Nepal. The peculiarity of this constitution is inclusion of modern norms with aggregation of tradition and culture and providing a large measure of justice and inclusion.
