Title:Sodelovanje javnosti pri varstvu okolja : primer fracking v Pomurju

Abstract:V diplomski nalogi so predstavljeni načini, kako lahko javnost sodeluje pri varstvu okolja, vloga, ki jo imajo pri tem nevladne organizacije, ter študija primera frackinga v Pomurju. Glavni namen diplomskega dela je analiza pravnih virov, ki določajo pogoje za sodelovanje javnosti pri izdajanju okoljevarstvenih soglasij in dovoljenj, splošen pomen okoljske ozaveščenosti in sodelovanja javnosti za trajnostni razvoj, ugotovitev morebitnih posebnosti ter njihova pravna ureditev v Sloveniji. Posebna pozornost je posvečena delom nove protikoronske zakonodaje, kjer se ta dotika pogojev za sodelovanje nevladnih organizacij pri okoljevarstvenih postopkih. Prav tako je analizirana sprememba v zakonu o ohranjanju narave glede pogojev za delovanje nevladnih prganizacij v javnem interesu. Diplomsko delo poskuša odgovoriti na raziskovalno vprašanje, ali je javnost dovolj vključena in upoštevana v postopkih varstva okolja. Seveda na to raziskovalno vprašanje ni enoznačnega odgovora, saj so v zakonih vse potrebne predpostavke za vključevanje javnosti ter za dostopnost informacij, vendar v praksi velikokrat niso upoštevane, še večkrat pa javnost teh možnosti niti ne izkoristi.

Abstract:In diploma thesis it will be presented, in which ways the public can participate in environmental protection, the role of non-governmental organizations and the case of fracking in Pomurje. The main purpose of the work is the analysis of legal sources that determine the conditions for public participation in issuing environmental consents and permits, the general importance of environmental awareness and public participation for sustainable development, identifying possible specifics and their legal regulation in Slovenia. Special attention is paid to the work of the new "anti-corona" legislation, where it touches on the conditions for the participation of non-governmental organizations in environmental protection procedures. There is also examined an amendment to the Nature Conservation Act regarding the conditions for the operation of non-governmental organizations in the public interest.Through the thesis, the the research question is beeing answered: Is the public sufficiently involved and taken into account in environmental protection procedures? Of course, there is not an unambiguous answer to this research question, I found that the laws have all the necessary prerequisites for public involvement and access to information, but in practice they are often not taken into account, and many times the public does not even use these opportunities.
