Title:Ohranjanje in reprodukcija umetniških in zgodovinskih del skozi pravice intelektualne lastnine : diplomsko delo

Abstract:Diplomsko delo predstavlja pogled prava na tehnike ohranjanja in reprodukcije umetniških del, posebej skozi pravice intelektualne lastnine, ter razmerje med lastninsko pravico in javnim dobrom, še posebej, kar zadeva kulturne znamenitosti. V začetku so opredeljene pravice intelektualne lastnine in avtorska pravica v umetnosti. Pomembnost te tematike je v težki naravi umestitve umetnosti v rigidne okvire pravne sfere, različnih načinih, kako bi dela pravno in dejansko zavarovali za prihodnje generacije, ter posebni problematiki, ki se pojavlja ob vsakršnem soočanju lastninske in avtorske pravice. Osredotoča se na opredelitev izvirnega dela in ved, ki se z ohranjanjem in reprodukcijo del ukvarjajo, ter tako povzame bistvene lastnosti arheologije, muzeologije in etnografije ter njihove vplive na izvirno delo, prav tako pa na tehnike in načine njegovega predelovanja, ki narekujejo podaljšanje in zavarovanje samega obstoja dela. Srečamo se z inspiracijo, predelavo in reprodukcijo, pri kateri gre predvsem za kopistiko iz ene vrste likovnih del v enake ali druge. Drugi del naloge je posvečen javnemu dobru in predvsem kulturni dediščini. Opredeljeni sta lastninska pravica in njeno delovanje, prav tako pa tudi njeno konkuriranje z javnim dobrom in pogoji, ki so le-temu v prid pri morebitnem razlastninjenju. Uporabljene metode dela so interpretativna, analitična, primerjalna in zgodovinska.

Abstract:The thesis represents ways in which intellectual property rights are protected and preserved when it comes to works of art. It will show the relationship between au thor's rights and property rights with a special focus on cultural and natural monuments. The beginning holds the definition of intellectual property rights with a special focus on author's right in regards to works of art. The importance of this topic comes through when we are presented with the challenge of defining the fluid nature of art in the rigid framework of the law, and the role that conservation and similar practices play in restoring and preserving works of art for future generations. The focus of this thesis lies in defining the criteria for the original work, i.e. the work that inspired future modifications, and the techniques of its reproductions or changes. It will discuss the many sciences that perform those actions, such as archeology, museology and ethnography. We will also come across defining inspiration, moderation and reproduction of a work and how that affects its origin, as described before as the original work, as well as looking at the relationship between public good and property rights, and conditions needed for expropriation. The methods used are the interpretative, the analytic, the comparative and the historical method.
