Title:Pravni vidik problematike mladostnikov s čustvenimi in vedenjskimi težavami, nameščenih v vzgojnih zavodih : diplomsko delo

Abstract:Obravnava otrok s čustvenimi in vedenjskimi motnjami (v nadaljevanju ČVM) se opravlja v skladu z ZUOPP-1. Več let pa se že pojavljajo težnje po novi ureditvi, ki bi urejala tudi otroke in mladostnike, ki še niso prepoznani kot otroci in mladostniki s čustvenimi in vedenjskimi motnjami, imajo pa čustvene in vedenjske težave. Stroka in praksa ugotavljata, da je obravnava otrok s ČVM velikokrat prepozna in da bi z ustrezno spremembo zakonodaje in uvedbo določenih načinov lažje pravočasno ukrepali ter obravnavali otroka na način, da kasneje ne bi prišlo do potrebe po namestitve v vzgojni zavod. S preventivo bi hkrati zmanjšali bremena vzgojnih zavodov, ki se v zadnjih letih soočajo z velikim porastom nameščenih otrok. Namen diplomske naloge je z normativno metodo širše predstaviti opredelitev oz. pravno podlago otrok in mladostnikov s ČVM ter njihovo obravnavo, pa tudi vzgojnih zavodov. Cilj pa je opozoriti na sistematično ureditev obravnave tako otrok s čustvenimi in vedenjskimi težavami oz. motnjami kot tudi vzgojnih zavodov. Na pomembnost spremembe zakonodajne ureditve kaže že dejstvo, da je bil v letu 2019 podan predlog novega zakona za to področje. Z deskriptivno metodo ter pregledom literature je v diplomskem delu predstavljen tudi vpliv družinskega okolja na razvoj čustvenih in vedenjskih težav oz. motenj pri otrocih in mladostnikih. Vmes se s pregledom sodne prakse obravnavanega področja predstavi dosedanje izkušnje slovenskega pravosodja in podkrepi opisano problematiko.

Abstract:The treatment of children with emotional and behavioural disorders (herein EBD) is performed in accordance with the Placement of Children with Special Needs Act. For several years, there has been a tendency towards a new regulation that would also regulate children and adolescents who have not yet been recognized as children and adolescents with emotional and behavioural disorders but have emotional and behavioural problems. The treatment of children with EBD is often too late and that appropriate changes in legislation and the introduction of certain methods would make it easier to take timely measures and treat the child in such a way that there is no need for placement in a residential treatment institution. Prevention would also reduce the burden on residential treatment institutions, which have been facing a large increase in the number of children in recent years. The purpose of the diploma thesis is to present the definition or legal basis of children and adolescents with EBD and their treatment with a normative method, and to present residential treatment institutions. In 2019, a proposal for a new law in this area was submitted, which shows the importance of amending the legislative regulation. With the descriptive method and the review of the literature, the thesis also presents the influence of the family environment on the development of emotional and behavioural disorders. A review of the judicial practice on the field in question presents the current experience of the Slovenian judicial system and supports the described issues.
