Title:Razmerja med razvezanima zakoncema s poudarkom na stanovanjskem varstvu : diplomsko delo

Abstract:Diplomska naloga obravnava razmerja med razvezanima zakoncema, in sicer preživnino, delitev skupnega premoženja, vračanje daril ter stanovanjsko varstvo, na čemer je poudarek. S pomočjo deskriptivne metode so razloženi osnovni pojmi, s pomočjo zgodovinskega pregleda so analizirani zakoni, predstavljena pa je tudi ureditev nekaterih tujih zakonodaj. Namen diplomske naloge je predstavitev dvanajstega poglavja Družinskega zakonika in globlja analiza stanovanjskega varstva. Preučili bomo več primerov, in sicer primer zakoncev, katerih stanovanje je v skupnem premoženju, primer zakoncev, kjer ima izključno lastninsko pravico ali v soposesti s trejo osebo na stanovanju zgolj en izmed zakoncev, ter primer, v katerem zakonec izvaja nasilje nad drugim zakoncem. Cilj diplomske naloge je potrditev oziroma ovržba hipotez, hkrati pa se želi z diplomsko nalogo predstaviti zakonsko ureditev stanovanjskega varstva skozi zgodovino, kako se ga je urejalo ter predloge in opozorila tako državnih kot evropskih organov. Institut stanovanjskega varstva do sprejetja Družinskega zakonika ni bil urejen, sodišča so morala sama zapolniti pravno praznino, ki jo je pustil zakonodajalec, zato se je tako na evropski kot na državni ravni pojavila splošna potreba, da se omenjeno področje celovito in sistematično uredi. Problematika stanovanjskega varstva se je začela pojavljati v zadnjih letih prejšnjega tisočletja in dobila precejšnje zanimanje za njeno ureditev.

Abstract:In this degree paper are discussed the relations between divorced spouses, alimony, division of joint property, return of gifts and housing protection, which is the focus of degree paper. The basic concepts are explained with the help of a descriptive method, the laws are analysed with the help of a historical overview, and the regulation of some foreign legislations is also presented. The purpose of the degree paper is to present the twelfth chapter of the Family Code and a deeper analysis of housing protection. We will examine several cases, for example the case of spouses whose apartment is in joint property, the case of spouses where only one of the spouses has exclusive ownership or co-ownership with a third person of the apartment, and the case in which the spouse commits violence against the other spouse. The aim of the degree paper is to confirm or refute hypotheses, and at the same time the diploma thesis aims to present the legal regulation of housing protection throughout history, how it was regulated and proposals and warnings from both national and European authorities. The institute of housing protection was not regulated until the adoption of the Family Code, the courts had to fill the legal gap left by the legislator, so there was a general need at both European and national level to regulate this area comprehensively and systematically. The issue of housing protection began to appear in the last years of the last millennium and gained considerable interest in its regulation.
