Title:Sovražni govor : analiza sodne odločbe VSRS in ESČP

Abstract:Skozi diplomsko delo je raziskana problematika glede sovražnega govora, ki je trenutno eden najbolj zahtevnih izzivov za razrešitev v danajšnjem svetu. Na začetku so opisane razlike stereotipov, predsodkov, diskriminatornih predsodkov in diskiminacije. Vsi našteti so pomemben ključ za lažje razumevanje pojava sovražnega govora. Podrobneje je povzeto, kje vse je reguliran sovražni govor tako posredno kot neposredno po nacionalnih in mednarodnih določbah. Sam temelj demokracije predstavlja svoboda do izražanja misli, vere, vesti in idej, zato so določbe jasne, da je prepovedano javno spodbujanje in razpihovanje sovraštva, spodbujanje k neenakopravnosti in nestrpnosti ter k nasilju in vojni. Kljub jasnim določbam se svet razvija s svetlobno hitrostjo in pravzaprav še ni urejeno vsako področje, ki je nujno za razrešitev oziroma omejitev sovražnega govora. Družbo v vsakem prelomnem obdobju zaznamuje neko pomembno vprašanje, naše je ureditev sovražnega govora, kar lahko v posledici pripelje do močno preoblikovane demokratične družbe. V diplomskem delu je tako analizirana sodba Vrhovnega sodišča, kot tudi sodba Evropskega sodišča za človekove pravice, katera je nujna analize, saj lahko takšna odločitev sodišča pusti hujše posledice za nadaljnji razvoj svobodne in strpne demokratične družbe.

Title:Sovražni govor - analiza sodne odločbe VSRS in ESČP : diplomsko delo
Abstract:The thesis researches the issue of hate speech, which is presently one of the most demanding challenges to be resolved in today's world. At the start, the differences between stereotypes, prejudices, discriminatory prejudices, and discrimination are described. All of the above are important keys to understanding the phenomenon of hate speech. The thesis summarizes in more detail where hate speech is regulated - both directly and indirectly - through national and international provisions. The freedom to express thoughts, religion, conscience, and ideas are the very foundation of democracy, consequently, the provisions are clear. Public incitement and incitement to hatred, incitement to inequality and intolerance, and violence and war are prohibited. Despite the clear provisions, the world is evolving at lightning speed, thus, not every sphere essential to addressing and resolving or limiting hate speech has, in fact, yet been regulated. Society is characterized by a fundamental issue at every turning point and our focus is the regulation of hate speech. This, in turn, can lead to a heavily transformed democratic society. The thesis analyses the judgement of the Supreme Court as well as the judgment of the European Court of Human Rights. Both must be analysed due to the high importance of any decision that is made by the court as it can have serious consequences for the further development of a free and tolerant democratic society.
