Abstract:Notarski zapis ima učinek javne listine in je neposredno izvršljiv, kar pomeni, da dokazuje resničnost tistega, kar je v njem zapisano. Notarski zapis sestavi notar, kadar stranke želijo večjo pravno varnost. Najemna pogodba mora biti sklenjena v pisni obliki, vendar za sklepanje ni z zakonom predpisane oblike (lahko so sestavljeni kot zasebna listina ali pa v notarskem zapisu). Stranke se same odločijo, v kakšni obliki bo najemna pogodba sestavljena, prav tako se same dogovorijo glede vsebine. Najemna pogodba mora vsebovati sestavine, ki so določene z zakonom. Stranke najemnega razmerja se ravno zaradi teh dveh značilnosti notarskega zapisa vedno pogosteje odločajo za sklepanje najemnih pogodb v obliki neposredno izvršljivega notarskega zapisa. Pogoji za neposredno izvršljivost do določenosti obveznosti, zapadlost terjatve in dolžnikovo soglasje z izvršljivostjo. Če najemnik prostovoljno ne izpolni svoje obveznosti (plačilo najemnine in stroškov, izselitev iz prostora najema), lahko najemodajalec s tožbo zahteva izpolnitev svoje terjatve. Če je najemodajalec uspešen s tožbo, lahko na podlagi pravnomočne in izvršljive sodne odločbe predlaga izvršitev. Vendar sodišče dovoli izvršbo tudi na podlagi drugih izvršilnih naslovov in ne le na podlagi sodnih odločb. Med izvršilne naslove spada tudi izvršljiv notarski zapis.

Abstract:A notarial act has a legal effect of a public document and is directly enforceable, meaning that it proves the accuracy and existence of it is content. A notarial act is drawn up by a notary when the parties want a greater legal certainty. The tenancy agreement must be concluded in writing; however, there is no legally prescribed form to conclude it (it can be drawn up as a private document or a notarial act). Clients themselves decide in what form the lease agreement will be drawn up, and they also agree on the content. The tenancy agreement must contain the components specified by law. Because of these two characteristics, clients are more drawn to conclude lease agreements in the form of a directly enforceable notarial act. Conditions for direct enforceability until the obligation is determined, claim's maturity, and the debtor's consent for enforceability. If the tenant voluntarily fails to fulfill his obligation (payment of rent and costs, eviction from the leased premises), the landlord may file a lawsuit to fulfill his claim. If the landlord is successful with the lawsuit, he can propose enforcement on the basis of a final and enforceable court decision. However, the court may also allow enforcement based on other enforcement titles and not only based on court decisions. Enforceable titles also include an enforceable notarial act.
