Title:Starševske odsotnosti in nadomestila : diplomsko delo

Abstract:V diplomskem delu je podan pogled na urejenost starševskih odsotnosti (materinski, očetovski in starševski dopust) in pripadajočih nadomestil v slovenskem pravnem redu. Predstavim tudi starševski dodatek, ki je namenjen osebam, ki niso upravičene do nadomestila. Opišem tudi novo Direktivo EU s tega področja in novosti, ki nas čakajo z implementacijo le-te. Zaključim s pregledom pravic staršev v delovnih razmerjih. Pri pisanju bomo uporabili metodi razlage pravnih aktov (jezikovna in deskriptivna metoda), ki mi bosta pomagali dosledno opisati pravno ureditev in razrešiti morebitna vprašanja. Namen diplomske naloge je analizirati pravno urejenost področja starševskih odsotnosti in nadomestil. Cilj je ugotoviti, ali je področje dobro urejeno, se glede ureditve pojavljajo vprašanja in preveriti usklajenost z minimalnimi zahtevami EU. Zaključim lahko z ugotovitvijo, da slovenski pravni sistem te pravice bogato ureja, kar pomeni, da velikih sprememb tudi z implementacijo nove direktive EU ni pričakovati. Poznavanje pravic pa je za starše pomembno, saj jim omogoča boljše usklajevanje družinskih in poklicnih obveznosti. Potrebna je tudi njihova angažiranost pri uveljavitvi pripadajočih jim pravic v delovnih razmerjih, saj njihova izraba ni vedno najbolj ugodna za delodajalce.

Abstract:In this diploma thesis I present the organization of the parental rights to leave (maternity, paternity and parental leave) and the corresponding benefits in the Slovenian legal system. I also present the parental bonus for persons who are not entitled to the benefits. I present the Directive of the European Union and the changes that will be necessary with its implementation. I conclude with the overview of the parental rights in the employment relationships. I use the explaining of legal acts method (linguistic and descriptive method) which will enable me to describe the legal regulations consistently and to answer the possible questions that may arise. The aim of the diploma thesis is to analyse legal regulations of the parental rights to leave and the corresponding benefits. The aim is to establish whether the field is organized properly, are there any questions arising regarding the organization of the field and if it meets the minimum criteria given by the European Union. In conclusion, I can affirm that the Slovenian judicial system is rich in organizing this rights which means that there will be no major changes in this field with the implementation of the Directive of the European Union. It is important that the parents are informed about the rights that they are entitled to since they enable them to coordinate the professional and private aspects of life more effectively; that is why it is their responsibility to know and assert their rights in the employment relationships.
