Title:Splošna deklaracija človekovih pravic : diplomsko delo

Abstract:Splošna deklaracija človekovih pravic je najpomembnejši dokument na področju varstva človekovih pravic, ki ga je sprejela Organizacija združenih narodov. Deklaracijo je sprejela in razglasila Generalna skupščina Združenih narodov 10. decembra 1948 v Parizu. Njen poglavitni avtor je John Peters Humphrey, pri pisanju pa so sodelovali tudi drugi avtorji. Deklaracija je kot ključen dokument prva v zgodovini dosegla, da se je mednarodno dogovorilo in priznalo, da se človekove pravice in temeljne svoboščine nanašajo na vsakogar in so prisotne vsepovsod. Sestavljena je iz preambule in 30-ih členov. Najpomebnejše načelo je načelo univerzalnosti, ki ga prav ta Deklaracija poudari prvič in je temelj prava človekovih pravic. Človekove pravice so prirojene in pripadajo vsakomur ne glede na spol, raso, narodnost, jezik, nacionalno ali etnično pripadnost, ali katero koli drugo osebno okoliščino. Splošna deklaracija človekovih pravic ni formalni instrument, a so ga kljub temu v praksi prevzele skoraj vse države sveta. Dokaz, da so posamezni deli Deklaracije skozi čas postali običajno pravo, je, da se večina držav sveta v svojih aktih sklicuje prav nanjo. Ena izmed teh držav je tudi Slovenija.V nadaljevanju bomo podrobneje opisali, kako se ta raba kaže v slovenskih aktih. Prvi dokaz je viden v Ustavi Republike Slovenije, kjer imamo podrobneje in natančneje opisane vse človekove pravice in temeljne svoboščine, katerih vir je prav Deklaracija.

Abstract:The Universal Declaration of Human Rights is the most important document in the field of the protection of human rights, which was proclaimed by the United Nations. The Declaration was issued and proclaimed by the UN General Assembly in Paris on 10 December 1948. Many authors contributed to the writing of the draft of the Declaration, but its lead author is John Peters Humphrey. The historic achievement of the Declaration is the fact that this document was the first internationally acknowledged document, which proclaimed that everyone is entitled to human rights and fundamental freedoms. The Declaration consists of a preamble and 30 articles. The primary principle is the universality principle, which is stressed by the Declaration for the first time, and is the basis of human rights law. Human rights are innate and everyone is entitled to all the rights regardless of their sex, race, language or any other personal circumstances. The Declaration is not a formal instrument, however, the Declaration has been practically adopted by almost all states. The evidence that some of the articles from the Declaration have become common law over the time, is seen from the fact that most of the states refer to it in their legal files. One of these states is also Slovenia and therefore I will be focusing on our legal files. The first evidence is seen in the Constitution.
