Title:Posvojitev otroka s strani ene osebe : diplomsko delo

Abstract:Posvojitev je posebna oblika varstva otrok, za katere starši ne skrbijo ali staršev sploh nimajo. Pri posvojitvi nastane med posvojiteljem in posvojencem enaka družinska vez, kot je med starši in njihovimi otroki. Temeljni zakon, ki ureja posvojitev v slovenski zakonodaji, je Družinski zakonik, ki je nadomestil dolga leta veljaven Zakon o zakonski zvezi in družinskih razmerjih. Zakon določi pogoje za posvojitev, tako na strani posvojenca kot na strani posvojitelja. Določi tudi organe, ki pri posvojitvi sodelujejo, to so sodišča in centri za socialno delo. Zakon posvojitev omogoči tako zakoncema kot zunajzakonskima partnerjema, ne pa tudi istospolnemu paru. Ena oseba sama sme posvojiti samo otroka svojega partnerja ali sme posvojiti sama zgolj izjemoma, če je to otroku v korist. Otrokova korist je načelo in cilj, ki mora biti zasledovan ves čas postopka posvojitve. Presoja se v vsakem posameznem primeru. Vsakršna deviacija od tega načela bi morala pomeniti prekinitev postopka in iskanje drugačne možnosti posvojitve ali druge skrbi za konkretnega otroka. Zakon dovoljuje tudi mednarodno posvojitev, tako Slovencem v tujini kot tujcem v Sloveniji. Slednjo zgolj izjemoma, kadar otroku ni mogoče najti primernega posvojitelja v državi. Mednarodna posvojitev pa se v Sloveniji priznava s postopkom priznanja sodne odločbe.

Abstract:Adoption is a special form of childcare for children without parents or for children whose parents do not care for them. With adoption process the same family bond establishes between the adoptee and adoptive parent as the one between parents and their biological children. The basic law regulating adoption in Slovenian law is the Family Code which replaced long ruling Marriage and Family Relations Act. Family code sets out conditions for adoption, both on the adoptee side as well as on adoptive parent side. Bodies involved in the adoption, such as courts and social work centres are also designated. Family code allows adoption for spouses and unmarried partners but not to the same-sex couples. One person may adopt only their partner's child or alone but only in exceptional cases and under condition the adoption in in the benefit of the child. Child's benefit is a principle and a goal which must be pursued throughout the adoption process. It is assessed on a case-by-case basis. Any deviation from this principle should result in the interruption of the process and finding of another, better, option for adoption for this particular child. International adoption is also allowed by the Family code. Slovenians may adopt from abroad as well as foreigners here. The latter is an exception in case suitable adoptive parents cannot be found for an adoptee. International adoption is recognized in Slovenia through the process of recognizing a court's decision.
