Title:Razvoj avtorskega prava na slovenskem ozemlju od začetka 20. stoletja do danes : diplomsko delo

Abstract:Avtorsko pravo je relativno mlada pravna panoga, kljub temu da lahko, v primerjavi z drugimi pravnimi panogami, njegove zametke zasledimo tudi v precej oddaljeni preteklosti. Namen avtorskega prava je varovanje avtorja, fizične osebe, ki je ustvarila neko avtorsko delo. Njegov temelj je ustvarjalni akt, na podlagi katerega avtorju pripada avtorska pravica po sami naravi. Diplomsko delo z naslovom Razvoj avtorskega prava na slovenskem ozemlju od začetka 20. stoletja do danes je raziskava avtorske zakonodaje, ki se je na slovenskem ozemlju s časom spreminjala. V diplomskem delu so med seboj primerjani zakoni, ki so veljali od konca 19. stoletja pa vse do leta 1995, ko je bil sprejet Zakon o avtorski in sorodnih pravicah, in sicer na področju trajanja in dedovanja avtorskih pravic, razvoja avtorskega dela, avtorske pogodbe in avtorskega dela iz delovnega razmerja. Glede na obravnavano temo diplomsko delo temelji na sistematičnem iskanju in preučevanju domače in tuje literature, navezujoče se na področja, ki so bila preučevana. Pri pisanju diplomskega dela je uporabljena deskriptivna ali opisna metoda raziskovalnega dela, in sicer na podlagi knjig, internetnih virov in člankov, ki se navezujejo na obravnavano temo. V diplomskem delu je, v povezavi s sistematično, uporabljena tudi metoda zgodovinske razlage in na podlagi tega opisan razvoj avtorskega prava ter vpliv sodobnega časa in tehnologije na avtorsko pravico.

Abstract:Copyright law is a relatively new field of law, although one can find traces of it quite far in the past as well. The purpose of copyright law is to protect the person who created some sort of original work. The foundation for it is the creative act, upon which the copyright law belongs to the person who created the work by its very nature. This thesis is a research of copyright law and how it developed through time in the territory of Slovenia. We have intercompared laws from the end of the 19th century all the way to the year 1995, when the copyright and related rights act was passed, regarding the duration of copyrights and their inheritance, development of copyright work, copyright agreements and copyright work employment. This thesis is based on systematic research and study of domestic and foreign literature related to areas that we have studied. We used descriptive research methods and based this research on literature, internet sources and articles about the subject of this thesis. When writing this thesis we used the method of historical and systematic interpretation to try to describe the development of copyright law and how it was influenced by modern times and technology.
