Title:Odpust obveznosti v osebnem stečaju : diplomsko delo

Abstract:Postopek osebnega stečaja je postopek, v katerem fizična oseba zaradi prezadolženosti poskuša poplačati svoj dolg s premoženjem, ki je zajeto v stečajno maso, za neplačane terjatve pa morebiti doseči njihov odpust. V ta namen sodišče dolžniku določi preizkusno dobo, v kateri se preverja, ali si dolžnik prizadeva za čim boljše poplačilo upnikov ter ali izpolnjuje obveznosti, ki mu jih nalaga Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju. Cilj postopka je doseči istočasno in sorazmerno poplačilo upnikov, stečajnemu dolžniku pa zagotoviti rehabilitacijo z odpustom dolga, če dolžnik to predlaga in izpolni zakonsko predpisane pogoje, z izjemo tistih obveznosti, za katere ZFPPIPP določa, da se dolžniku ne odpustijo. Učinek zaključenega stečajnega postopka nad fizično osebo, podjetnikom ali posameznikom pa je tudi ta, da upniki za neplačani del priznanih terjatev v stečajnem postopku pridobijo izvršilni naslov. Stečajni postopek se konča, ko stečajni upravitelj po opravljeni končni razdelitvi sodišču predloži končno poročilo. Končnega cilja upnikov, da bi dosegli poplačilo svojih terjatev v postopku osebnega stečaja, pa največkrat ni mogoče doseči, ker stečajna masa za to ne zadošča. Kadar stečajne mase ni, se stečajni postopek konča brez razdelitve upnikom.

Abstract:A personal bankruptcy procedure is a procedure in which an individual, due to over- indebtedness, tries to repay his/her debt with the assets included in the bankruptcy estate, and for unpaid receivables obtain their forgiveness. For this sole purpose, the court sets a probationary period for the debtor, in which all the facts are checked whether the debtor strives for the best possible repayment of his/hers creditors and if he/she fulfils the obligations imposed on him/her by the Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act (ZFPPIPP). The aim of the procedure is to achieve simultaneous and proportionate repayment of creditors, and to provide the bankruptcy debtor with rehabilitation by debt forgiveness, if the debtor proposes this and meets the legally prescribed conditions, with the exception of those obligations for which ZFPPIPP stipulates that the debtor must not be forgiven. The effect of the completed personal bankruptcy proceedings is also that creditors obtain an enforceable title for the unpaid part of recognized receivables in the bankruptcy proceedings. Personal bankruptcy proceedings are terminated when the liquidator submits his/hers final report to the court after the final distribution of bankruptcy estate. However, the ultimate goal of creditors in order to achieve the repayment of their claims in personal bankruptcy proceedings cannot be achieved because the bankruptcy estate is not sufficient for this. When there is no bankruptcy estate, the bankruptcy proceedings end without distribution to creditors.
