Title:Žvižgači v razmerju do javnega interesa : diplomsko delo

Abstract:Živimo v dobi, v kateri so informacije orožje. Žvižgači so posamezniki, ki informacije, pridobljene ob delu, razkrijejo širši družbi oziroma javnosti, ker se jim to zdi moralno pravilno oz. ker je razkritje le-teh v javnem interesu. Zaradi svojih dejanj so nato po večini podvrženi preganjanju, socialni marginalizaciji, eksemplifikativnemu "maltretiranju", disciplinskim ali celo sodnim postopkom. Mediji imajo pomembno vlogo pri naznanjanju kršitev, saj se žvižgači v večini primerov obrnejo na njih za pomoč pri obveščanju javnosti o spornih ravnanjih. Družbena ureditev zahodne družbe temelji na demokratičnih in pravnih načelih, med katerimi ima javni interes pomembno vlogo, saj ta na načelni ravni ščiti posameznike pred nezakonitimi posegi države v njihove temeljne človekove pravice ter obratno, ščiti javnost pred nezakonitimi posegi posameznikov ali manjših skupin (politike) v pravice širše družbe. Žvižgači se v družbi pojavijo kot refleks na nespoštovanje in neupoštevanje temeljnih demokratičnih načel in temeljnih človekovih pravic. S svojim delom se trudijo, da bi osvetlili nezakonita in sporna ravnanja, ki so v nasprotju z načeli demokratične družbe. Žvižgač je branitelj javnega interesa, eden izmed "javnih psov čuvajev", ki se trudi in uresničuje temeljno človekovo pravico do informiranosti.

Abstract:We live in the era, in which the information is a power weapon. Whistleblowers are individuals, who disclose pieces of information obtained at work to the wider community or public, because they believe it is morally correct, i.e. that such disclosures are in public interest. Due to their actions, the majority of them are prosecuted, socially marginalized, subject to exemplified attacks, disciplinary or even court procedures. The media have an important role to play in announcing infringements, as whistleblowers in most cases turn to them for help in informing the public about controversial practices.The social order of western societies bases on democratic and legal principles among which the public interest has an important role, as, at principled level, it protects the individuals against illegal impairments of the state into their fundamental human rights and vice versa; furthermore, it protects the public against illegal impairments of individuals or minor groups (politics) into the rights of wider society. Whistleblowers appear in the society as a reaction to the violation and noncompliance of fundamental principles of democracy and human rights. With their work, they endeavor to bring attention to illegal and questionable actions, which are against the principles of a democratic society. A whistleblower is the defender of public interest, one of the "public watch-dogs", endeavoring and implementing the fundamental human rights to be informed.
