Title:Temeljna načela sodobnega mednarodnega prava in prepoved uporabe oborožene sile v času 1. svetovne vojne : diplomsko delo

Abstract:Delo v prvem sklopu temelji na problematiki upravičenosti uporabe oborožene sile v današnjem času in v času prve svetovne vojne. Današnji čas opredeljuje sodobno mednarodno pravo z mnogimi pravnimi akti, ki vsebujejo natančna in jasna pravila o uporabi oborožene sile in imajo naravo ius cogens. Poleg mednarodnih pravil pa vsaka država predpisuje tudi svoja nacionalna pravila o delovanju oboroženih sil. Danes je uporaba oborožene sile več kot dovolj pojasnjena in razložena v mnogih pravnih aktih. V času prve svetovne vojne in po njej pravni akti, ki bi opredeljevali oboroženo silo, še niso obstajali, zaradi pomanjkanja le-teh niti ne moremo govoriti o tedanjih pravilih načela ius cogens. Velik zgodovinski premik je prinesel novosti in potrebo po sprejetju in po natančnejših določilih pravil, ki so danes obvezujoča za vse države, ki na kakršenkoli način vstopajo v medsebojne odnose. Drugi sklop diplomskega dela pa zahteva pojasnitev pravil ius cogens sodobnega mednarodnega prava, pravil, katera je prinesla sama potreba po njihovem zapisu, zaradi globljega in vse večjega sodelovanja med suverenimi državami.

Abstract:First part of the paper is based on the issue of justification of usage of armed forces today and during the First World War. Present times are defined by modern international law with many legal acts that are subjects to jus cogens (nature) and contain intelligible and precise rules of the usage of armed forces. Besides international rules each country lays down its own national rules of operation of armed forces. Today the usage of armed froces is sufficiently explained with many legal acts. Legal acts that would defined the usage of armed forces had not yet existed during and after First World War. Furthermore, due to the lack of such legal acts the principle of jus cogens rule is not associated with that time. Historic event has brought changes and need for adoption of intelligible provisions and rules which are nowadays binding for all countries that in any way enter relations with one another. Second part of diploma paper requires the explanation of jus cogens principle of the modern international law and rules, which were solely brought into existence by the need of writting down existing norms due to closer and more frequent collaboration among sovereign countries.
