Title:Pravne specifike športnega prava : diplomsko delo

Abstract:Športno pravo je pravno področje, ki je v Evropi še v fazi razvoja, medtem ko je v ZDA že izoblikovano. Je podkategorija prava, ki je sestavljena iz preostalih pravnih področij, kot so delovno, obligacijsko, konkurenčno, pogodbeno, protimonopolno pravo itd. V Evropi se je njegov razvoj pričel z zadevo Bosman, ki se je navezovala na prost pretok delovne sile in izoblikovanje primernega prestopnega sistema, medtem ko v ZDA to nadomešča %draft%. Pri vključevanju mladih v profesionalni šport je med Evropo in ZDA precej razlik, saj imajo v ZDA ta prestop oblikovan zelo dovršeno. V sklopu protimonopolnega in konkurenčnega prava v povezavi s športnim pravom se srečamo s pravicami do predvajanja televizijskih prenosov. Pri tem se pojavi še antidoping, ki ga na območju Evrope in ZDA obravnava več različnih organizacij, katerih skupni cilj je preprečiti doping in istočasno ne posegati v ustavne pravice športnikov. Področje športnega prava pa se sooča tudi z diskriminacijo, ki se med Evropo in ZDA razlikuje predvsem po vrsti diskriminacije. Glede na to, da je evropsko pravo še v fazi razvoja, ima odprtih še veliko možnosti za svoje dokončno oblikovanje.

Abstract:Sports law is a field of law that is still under development in Europe, while in the United States it is already in place. Sports law is a subcategory of law that consists of other legal areas such as labour, contract, competition, antitrust and other areas of law. In Europe, its development began with the Bosman case, which was related to the free movement of labour and the creation of a suitable transfer system, while in the United States it replaced the draft. There are many differences between Europe and the USA in the inclusion of young people in professional sports, as the latter has a very perfect design. As part of antitrust and competition law, in connection with sports law, we encounter the rights to broadcast television broadcasts. There is also anti-doping, which is being addressed in Europe and the USA by several different organizations, whose common goal is to prevent doping and at the same time not to interfere with the constitutional rights of athletes. The field of sports law also faces discrimination, which differs between Europe and the United States mainly in the type of discrimination. Given that European law is still in the development phase, there are still many opportunities open for its final form.
