Title:Neposlovna odškodninska odgovornost : diplomsko delo

Abstract:Obligacijsko razmerje je pravno razmerje med upnikom in dolžnikom. Dolžnik je v določenem obligacijskem razmerju zavezan opraviti izpolnitveno ravnanje, upnik pa je le-to upravičen zahtevati. Odškodninsko razmerje je prav tako obligacijsko razmerje, kjer imamo oškodovanca (upnika), ki mu je nastala pravno priznana škoda in povzročitelja (dolžnika), ki je škodo povzročil. Tako je povzročitelj zavezan povrniti škodo (opraviti izpolnitveno ravnanje) oškodovancu. Da lahko govorimo o odškodninski obveznosti povzročitelja škode, pa se morajo steči še določena pravna dejstva, ki jih imenujemo predpostavke odškodninske odgovornosti. Odškodninska odgovornost se, kljub nasprotovanju nekaterih teoretikov, deli na poslovno in neposlovno odškodninsko odgovornost. Za poslovno odškodninsko odgovornost je značilno, da sta oškodovanec in povzročitelj škode pred škodnim dogodkom v pravno poslovnem razmerju, protipravnost pa se kaže kot kršitev pogodbenega določila. Pri neposlovni odškodninski odgovornosti pa stranki nista v pravnem razmerju. Neposlovna odškodninska odgovornost se deli na subjektivno, oziroma krivdno odškodninsko odgovornost, in na odgovornost ne glede na krivdo, oziroma objektivno odškodninsko odgovornost. Razlikujeta po predpostavkah, v dokazovanju le-teh in nenazadnje v njihovi pojavni obliki. V diplomskem delu bom v uvodu predstavil odškodninsko odgovornost nasploh, njene funkcije in njen zgodovinski razvoj. V nadaljevanju se bom posvetil neposlovni odškodninski odgovornosti, kjer bom iskal razlike med subjektivno in objektivno odškodninsko odgovornostjo, posebno pozornost pa bom namenil njihovim predpostavkam, saj bom poskušal najti razlike v njihovem dokazovanju in njihovi pojavni obliki.

Abstract:An obligation relationship is a legal relationship between obligee and obligor. The obligor is obliged to perform the fulfillment conduct of a certain obligation and the obligee is entitled to demand it. Indemnity is also a contractual obligation where we have an injured party who has incurred legally recognized damage and the person causing the damage. Thus, the indemnifier is obliged to compensate the indemnity holder. However, in order to be able to speak of an indemnity obligation for the person causing the damage, certain legal facts, called assumptions of the liability for damages, must be acquired. Liability for damages, is divided into contractual and non-contractual liability. Contractual liability is characterized by the fact that the injured party and the person causing the damage before the loss event are in a legal business relationship, and unlawfulness is manifested as a violation of a contractual provision. However, in the case of non-contractual liability, the parties are not in a legal relationship. Further, noncontractual liability is divided into subjective non-contractual liability and objective noncontractual liability, which differ in assumptions and in their proving. In the diploma thesis, I will first introduce the tort damages in general, their functions and their historical development. In the following, I will focus on non-contractual liability, where I will look for differences between subjective and objective liability, and I will pay particular attention to their assumptions as I will try to find differences in their proving and their manifestation.
