Title:Rejništvo - primerjava med ZZZDR in Družinskim zakonikom : diplomsko delo

Abstract:Rejništvo je ena od oblik, s katerimi se nadomešča starševska skrb. Je posebna oblika varstva otrok, ki jim je potrebna oskrba in vzgoja pri osebah, ki niso njihovi starši. Rejništvo spada v področje družinskega prava in do leta 2017 je področje urejal Zakon o zakonski zvezi in družinskih razmerjih, a ker je bil ta že zastarel, je bil leta 2017 sprejet nov Družinski zakonik, ki se je v polnem obsegu začel uporabljati aprila 2019. Družinski zakonik, na področju rejništva uvaja pomembne spremembe. Največja sprememba, ki je bila uvedena, je bil prenos odločevalske funkcije iz centrov za socialno delo na sodišča. Zato se je v veliki meri tudi spremenila funkcija Centrov za socialno delo. Pomembna novost, ki je bila uvedena z novim zakonikom, je ukinitev možnosti oddaje otroka v rejništvo po starših in tako je ukrep namestitve v rejništvo, možen samo kot ukrep države. Družinski zakonik prav tako uvaja omejitev trajanja ukrepov odvzema otroka na tri leta. Še vedno, kljub novi zakonodaji, na področju družinskega prava in rejništva pa temeljno vodilo ostaja enako % korist otroka ter ureditev razmer v biološki družini.

Abstract:Foster care is one of the forms that replaces parental care. It is a special form of care for children in need of care and upbringing for persons other than their parents. Foster care belongs to the field of family law and until 2017 the field was regulated by the Marriage and Family Relations Act, but as it was already obsolete, a new Family Code was adopted in 2017, which came into full force in April 2019. Family Code, introduces important changes in the field of foster care. The biggest change that was introduced was the transfer of the decision-making function from the centers for social work to the courts. As a result, the function of the Centers for Social Work has largely changed. An important novelty introduced by the new code is the abolition of the possibility of placing a child in foster care by parents, and thus the measure of placement in foster care is possible only as a measure of the state. The Family Code also introduces a limit on the duration of child abduction measures to three years. Still, despite the new legislation in the field of family law and foster care, the basic guideline remains the same - the benefit of the child and the regulation of the situation in the biological family.
