Title:Primerjava nasilja v družini po Zakonu o preprečevanju nasilja v družini in Kazenskem zakoniku : diplomsko delo

Abstract:Diplomsko delo obravnava primerjavo nasilja v družini po Zakonu o preprečevanju nasilja v družini in Kazenskem zakoniku. Poleg te primerjave opisuje tudi pojem, oblike in funkcije družine, opredelitev in vrste nasilja, njegove vzroke in posledice ter morebitne žrtve. Glavni namen in cilj diplomskega dela je ugotoviti, ali se število obravnavanih primerov nasilja v družini letno povečuje, potrditev hipoteze, da je največje število žrtev nasilja v družini na Goriškem ženskega spola, in obrazložitev obravnavanih primerov po Kazenskem zakoniku in Zakonu o preprečevanju nasilja v družini. Za ugotovitev zastavljenih ciljev je bil izveden kritičen pregled literature, statistike in sodne prakse. Glede na prebrano so bile podane naslednje ugotovitve, in sicer da se število obravnavanih primerov nasilja v družini letno ne povečuje, da je večina žrtev na Goriškem ženskega spola, da je povzročiteljem izrečena kazenska sankcija, neprištevnim storilcem pa varnostni ukrep psihiatričnega zdravljenja in varstva, da je nasilja v družini več vrst (psihično, fizično, spolno in ekonomsko nasilje ter zanemarjanje in zalezovanje), da so žrtve nasilja lahko tako moški kot ženske vseh starosti, vseh ekonomsko-socialnih, narodnih in etničnih skupin, ne glede na okoliščine. Med vzroke za nasilje v družini je potrebno uvrstiti težnjo po doseganju nadzora, ustrahovanje, podrejenost, izražanje jeze, stres, opitost, čustveno razburjenost, ljubosumje, travme iz otroštva itd.

Abstract:The subject of the thesis is a comparison of family violence according to the Family Violence Act and the Criminal Code. The thesis also contains a description of the concept, the forms and the functions of the family, the definition and the types of violence, the motives and the consequences and eventual victims. The main scope of the thesis is to establish whether the number of the family violence cases treated is increasing each year, to confirm the hypothesis that the majority of the victims in the Goriška region are female, and to offer an explanation of the cases treated on the basis of the Criminal Code and the Family Violence Act. In order to identify the objective pursued a critical review of the literature, of the statistics and of the case-law have been performed. Based on all the texts read the following conclusions have been drawn: the number of the cases treated is not increasing annually, the majority of the victims in the Goriška region are female, perpetrators are punished with criminal sanctions, on insane perpetrators the safety measure of compulsory psychiatric treatment is imposed, there are various types of family violence (psychological, physical, sexual, economic violence, neglect and stalking), the victims are both men and women of all ages, of all economic, social, national and ethnic groups, irrespective of the circumstances. The causes may be the desire to achieve control, intimidation, submission, expression of anger, stress, intoxication, emotional upset, jealousy, childhood trauma and others.
