Title:Trpinčenje v slovenski pravni ureditvi primerjalno z drugimi državami članicami EU : magistrsko delo

Abstract:Vse hujša konkurenca v zaostrenih tržnih pogojih, ki je odraz današnje globalno, potrošniško, kompetitivno usmerjene družbe, v delovno okolje različnih organizacij, še izraziteje vnaša tekmovalnost in posledično nasilno vedenje med zaposlenimi. V takih okoljih in razmerah se znižuje nivo varnosti zaposlitve posameznikov, obstoj njihovih delovnih mest ni več samoumeven in zato postajajo ranljivejši. Ob upoštevanju tržnih zakonitosti delo predstavlja vedno večjo vrednoto, zahtevo in pričakovanja s strani delodajalcev, delavci so deležni vse večjih groženj z odpuščanjem, ustvarjajo se pogoji, da zaposleni začnejo izvajati psihično nasilje nad sodelavci, s strani katerih se zaradi njihovega boljšega znanja, veščin in sposobnosti, počutijo ogrožene. Delovno okolje, zaradi hitrega tempa in načina življenja v današnjem času, predstavlja prostor, v katerem zaposleni posameznik preživi večino svojega aktivnega življenja, zato bi to okolje moralo predstavljati varno sredino, znotraj katere bi mu bilo omogočeno razvijati svoje talente in potenciale, vendar žal temu vedno ni tako. V tem pogledu tudi Slovenija ni izjema, vse bolj razširjeni pojavi trpinčenja na delovnem mestu predstavljajo resno grožnjo posameznikom, organizacijam in celotni družbi. Država na normativni ravni posameznikom zagotavlja prepoved kršitve trpinčenja in zagotavljanja dostojanstva na delovnem mestu in v zvezi s tem delodajalcem nalaga določene obveznosti glede zagotavljanja primernega delovnega okolja in ukrepov za njegovo zagotavljanje. V ta namen morajo delodajalci oblikovati in sprejeti ustrezne politike za preprečevanje trpinčenja na delovnem mestu, se opredeliti do nastalih pojavov, jih obsoditi kot nesprejemljive in poskrbeti za ustrezno sankcioniranje povzročiteljev.

Abstract:Increasing competition in the harsh market conditions, which is a reflection of today's global, consumer and competitively oriented companies, makes the competitiveness and consequent violent behavior among employees even more pronounced in the working environment of various organizations. Successful employers emphasize that good and harmonious relationships and a proper working climate are crucial for the successful functioning of organizations, as successful, dedicated and engaged personnel are more productive and efficient, which is reflected in higher employer profits. Taking into account market principles, work represents an increasing value, demand and expectation on the part of employers, workers face increasing threats of redundancies, creating conditions for employees to engage in psychological violence against employees who, due to their improved knowledge, skills and abilities feel threatened. Because of the fast pace and lifestyle of today, the work environment is a place where an employed individual spends most of his or her active life, so this environment should be a safe environment within which he should be able to develop his talents and potentials, but unfortunately it is not always so. In this aspect, Slovenia is no exception, and the widespread phenomenon of workplace bullying poses a serious threat to individuals, organizations and the entire society. The state, at the normative level, provides individuals with a prohibition on the violation of bullying and the provision of dignity in the workplace and imposes certain obligations on employers to ensure an adequate working environment and measures to ensure it. To this end, employers must formulate and adopt appropriate policies to prevent workplace bullying, identify the occurrences, condemn them as unacceptable and ensure that sanctions are properly sanctioned.
