Title:Služnostna pravica pri monetizaciji nepremičnin in zavarovanju energetskih objektov : doktorska disertacija

Abstract:Doktorska disertacija obravnava izzive v zvezi z zavarovanjem tveganj pri energetskih objektih. Stvarno pravo kot temeljno pravico opredeljuje lastninsko pravico, ki zagotavlja svojemu lastniku popolno oblast nad njo. Služnost je prav tako ena od stvarnih pravic. Služnost predstavlja pravico do uporabe tuje stvar ali izkoriščanja pravice oziroma zahtevati od lastnika stvari, da določena dejanja na tej stvari opušča ali pa dopušča. Prav tako služnost dopušča t.i. oblastnost na stvari. Ta oblast se deli med lastnika stvari in služnostnega upravičenca. Izzivi so ovrednoteni glede na najnovejše stanje razvoja elektroenergetike pri vzpostavitvi nizkoogljične družbe in regulativnih vprašanjih konvencionalnih virov energije v obnovljive vire energije. Osredotočali smo se na investicijske projekte v elektroenergetskem sektorju, katerega cilj je vzpostavitev nizkoogljične družbe, s ciljem zmanjšanja izpustov toplogrednih plinov in zanesljivosti preskrbe z električno energijo, ki bi bila neodvisnosna od fosilnih goriv. Namen doktorske disertacije je bilo vprašanje, kako obstoječa pravna ureditev zagotavlja pravno varstvo v primeru kršitev in kakšno obliko pravnega posla izbrati pri investicijskih projektih, da bi zmanjšali tveganje posla. Na podlagi teoretične razprave in analize izbranega primera in predhodnih akademskih raziskav smo ugotovili, da je element služnosti pri infrastrukturnih in energetskih naložbah pogosto spregledan element, ki lahko pospeši izkoriščanje zemljišč, zgradb in/ali njihovih posameznih delov. Menimo, da ima lahko služnost pozitiven vpliv na vrednotenje nepremičnin in da predstavlja bistven element pri pospeševanju investicij v energetske objekte oziroma zavarovanje v smislu zmanjšanja tveganja pri teh investicijah.

Abstract:This doctoral dissertation examines the challenges related to risk insurance of energy facilities. The fundamental right of property law is a property right that ensures the owner to assume absolute authority over the property. Servitude as a right to use a foreign property or assume the right to it or demand the user to refrain from using the property is a property right that ensures the authority over properties. This authority is divided between the owner and the dominant owner. The challenges are valued based on the newest stage of development of electricity in the implementation of low-carbon society and regulatory issues of the conversion from conventional energy sources to renewable energy sources. We focused on investment projects in the electricity sector, the aim of which is to create a low-carbon society as well as to reduce greenhouse emissions, the security of supply with electricity and the independence from fossil fuels. The aim of this doctoral dissertation is to examine how the existing legal arrangement ensures the rule of law in case of violations and what type of legal transactions to select in investment projects to reduce transaction risk. Based on the theoretical discussion and the analysis of a selected case and previous academic research, we determined that servitude is most frequently overlooked in infrastructure and energy investments; however, this element can facilitate the use of land, facilities and/or their individual parts. We believe that servitude can have a positive impact on real estate evaluation and that it presents a substantial element in facilitating investments into energy facilities or insurance in the context of risk reduction in these investments.
