Title:Vpliv transnacionalnega prava na preobrazbo države : doktorska disertacija

Abstract:Dejstvo je, da je obdobje moderne zamenjalo obdobje postmoderne, kar prinaša predvsem na pravnem področju številne spremembe in nove značilnosti. Država je postala le ena izmed ustvarjalk prava in na državno ozemlje je počasi začelo vstopati transnacionalno pravo. To pravo ustvarja preko številnih nedržavnih in vse bolj funkcionalnih akterjev in institucij nova pravila, pri čemer država in še manj državljani največkrat ne sodelujejo, vendar jih morajo kljub temu spoštovati enako kot državna pravila. Transnacionalno pravo je še dokaj nepoznano (in včasih celo zanikano) pravo, ki pa pomembno vpliva na preobrazbo države (v smislu njene suverenosti, demokracije, načela pravne države, človekovih pravic, institucij) in državnega prava (njegove hierarhije, skladnosti, stabilnosti, jasnosti, predvidljivosti). Ti vplivi in učinki hudo kršijo marsikatero pravico državljanov, v nekaterih primerih pa lahko celo povzročijo nižanje splošne kakovosti življenja v državi. Obenem transnacionalno pravo ne prinaša vedno le grožnje, ampak lahko prinese tudi nove priložnosti in pozitivna prestrukturiranja v državi. Prav zato morajo postmoderne države razmišljati o tem, kako bi lahko čim bolje izkoristile priložnosti transnacionalnega prava in hkrati omejile njegove negativne vplive oz. kako bi lahko v svoji ureditvi čim bolje povezale moderne in postmoderne elemente. Eno izmed rešitev zagotovo predstavljajo spremembe v pravnem izobraževanju, ki bi prinesle novo znanje o transnacionalnem pravu, predvsem pa zavedanje o njegovem obstoju in pomembnosti. Z boljšo pravno izobrazbo o transnacionalnem pravu bi tako lažje dosegli ustrezen dialog med modernimi in postmodernimi trendi na način, da bi države v kar največji meri ohranjale svojo suverenost, demokratičnost in druge pomembne vrednote ter hkrati svoja šibka državna področja izboljšale s pomočjo ustreznih transnacionalnih norm. Tako bi (pravni) svet postal boljši in pravičnejši.

Abstract:The fact is that the era of modernism has been succeeded by postmodernism which brought numerous changes and new characteristics mainly in the field of law. The state turned into one of the lawmakers and the transnational law slowly started to make an appearance on the national territory. This law makes new rules through many non%state and increasingly functional agents and institutions. The state and its citizens most often do not take part in the rule-making process, but still have to obey them in the same way as the state rules. Transnational law is a fairly unknown (and sometimes even denied) law that nevertheless importantly affects the transformation of the state (in terms of its sovereignty, democracy, principles of the rule of law, human rights, institutions) and the state law (its hierarchy, uniformity, transparency, predictability). These influences and effects severely violate many of the citizens% rights. In some cases they may even cause a decline in the general quality of life in the country. On the other hand, the transnational law does not always represent a threat. It can also bring new opportunities and positive restructuring of the country. Therefore the postmodern countries have to find the solution how to use the opportunities that the transnational law brings and at the same time limit its negative effects. In other words they need to find a way to connect modern and postmodern elements in its regulation in the best possible way. One of the ways to address this challenge would be to introduce changes in the legal education that would bring new knowledge of the transnational law and above all the awareness of its existence and importance. A better legal education in the field of transnational law would contribute to a better dialog between modern and post-modern trends. The states would preserve their sovereignty, democracy and other important values as much as possible and at the same time improve their weak fields with the help of the appropriate transnational norms. In this way the (legal) world would become better and fairer.
