Title:Imuhar in tuareška država Azawad - vloga naroda in njegove identitete v mednarodnem in islamskem pravu : doktorska disertacija

Abstract:Preučevanje Tuaregov kot naroda, njihove identitete in pravice do samoodločbe temelji na predpostavki, da so Tuaregi na osnovi zgodovinskih, jezikovnih in kulturnih dejstev narod, ki so jim bile odvzete številne pravice z vsiljenim nastankom novih držav sredi 20. stoletja v Severni Afriki. Pravice, ki naj bi bile zapisane v ustavah teh državah, se v praksi večinoma ne izvajajo. Tuareška država Azawad, ki mednarodno ni priznana, je nastala leta 2012 na ozemlju Tuaregov. Pravico do samoodločbe MNLA utemeljuje, da je država Mali nad njimi od leta 1960 izvajala grobe kršitve človekovih pravic, zaradi česar so bili primorani zapuščati svoje domove in se seliti tudi v sosednje države. Ob analizi opravljenih intervjujev in anket med Tuaregi je bilo ugotovljeno, da je mednarodna praksa, zlasti tista, ki je bila pod vplivom neuvrščenih držav, šla po poti, da se dekolonizacija izvede kot uveljavljanje pravice do samoodločbe na temelju tistih entitet, ki so jih ustvarile kolonialne metropole. Uveljavljena praksa je prizadela tudi Tuarege, saj so bile upoštevane meje nekdanjih kolonialnih enot. Afriške države so pričele uveljavljati pravico do samoodločbe pod vplivom dogajanj v Evropi, ko se je sprejelo stališče, da uresničevanje pravice do samoodločbe naroda ni samo dekolonizacija.

Abstract:The study of the Tuareg people as a nation, their identity, and their right to self-determination are based on the assumption that based on historical, linguistic, and cultural facts the Tuareg are a nation deprived of many rights by the forced emergence of the new states in North Africa in the mid-20th century. The rights that are supposed to be written in the constitutions of these countries are generally not exercised in practice. The Tuareg state of Azawad, which is not internationally recognized, was formed in 2012 on the territory of Tuaregs. The MNLA justifies the right to self-determination by the fact that the State of Mali has committed gross human rights violations against them since 1960, forcing them to leave their homes and move to neighbouring countries. The analysis of field interviews and surveys of Tuaregs found that international practice, especially the one influenced by the non-aligned countries, followed the path of decolonization as an exercise of the right to self-determination based on those entities that are created by colonial metropolises. It took a long time for individual ethnic communities to secede from one of the newly formed states. As practice was established, which also affected the Tuareg, namely that the borders of the former colonial units were taken into account. African countries began to exercise their right to self-determination under the influence of events in Europe when the position was adopted that the exercise of the nation's right to self-determination was not just decolonization.
